Not counting all people could backfire to the extent that the allocation of federal money may be affected by counting only citizens for reapportionment purposes, not to mention how seats are allocated. Could a state drawing lines based on citizen votes still be allowed to claim all residents for purposes of how many seats the state is assigned? Trying to use two different measure of population could raise some interesting legal questions, as could different states taking different approaches.

With a normal Supreme Court, I would agree with you. Unfortunately, that is not what we have on offer today. What we will have on offer is pretzel logic. Queue Steely Dan:

Note that the conservatives want non-citizens (and those not eligible to vote, like children) to be counted in deciding how many representatives each state is allocated, but then only use voting age citizens to set up the districts. Translation … older whites keep power in their hands until they die off.

I’m afraid this will end, post-voting-age-citizen-based-redistricting, with a case in front of the Supreme Court and the plaintiffs (whoever they are) being told they don’t have standing. This has been a go-to move by GOP judges in the past few years.

Two different jurisdictions. The conservative bloc on the Supreme Court will point to the Constitution and say it is clear that the “manner of holding elections [i.e., drawing districts within the state] for Senators and Representatives, shall be prescribed in each state by the legislature thereof” and there is nothing to prohibit the use of voting age or any other demographic standard the state legislature may choose. It is also clear that the number of districts, federal funding and all other government benefits “shall be apportioned among the several states according to their respective numbers.”

That will be the attempt: to use a maximal standard for reapportionment (assigning congressional seats to states), then a discriminatory citizen count standard for redistricting within a state. I will note that the article sloppily uses the word apportionment to mean both reapportionment and redistricting.
