The world is ending, but that doesn’t mean we can’t be pedantic.
the aggrandizement of power to the Supreme Court
I’ll go with “the arrogation of power to the Supreme Court”, or, since “aggrandizement” is increase of power, “the aggrandizement of the Supreme Court”.
It was obvious as soon as the Supreme Court decision came down Monday that not only were the three ongoing prosecutions of Trump now deeply in jeopardy, but so was his conviction in New York state court in the hush-money case.
True that Merchan has to hear immunity arguments in the NY election interference case and delay sentencing, but the evidence and the verdict do not seem to be at significant risk. The plan and the actual payment took place before Trump was president. Yes, the false records and the reimbursements were made in 2017, but the documents were created and the payments were made by Trump personally and employees of his businesses. Michael Cohen was not an government employee, he was Trump’s personal attorney. The witnesses were not government employees. (His assistant testified that the cheques were received, signed and sent back from the WH, but she wasn’t describing an official act.) He signed the cheques in the Oval Office, but there doesn’t seem to be anything that could remotely be considered an official act. It was all done in his personal capacity.
Thank you for another wonderful MM. I’m afraid my reaction post debate/Supreme Court run amok week has been numbness and your Morning Memos have kept me focused. You deserve a great holiday break.
There is precisely one person on the planet who can confirm or refute that last week’s debate performance showed that President Biden is too brain-addled to win and serve a second term, and he remains in hiding from the public.
[Roberts] opened to door for any future President who wants to break laws to do so with impunity
The Justice’s Oath
“I do solemnly swear or affirm that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me, according to the best of my abilities and understanding, agreeably to the constitution and laws of the United States. So help me God.”
I watched the interview thinking that it would be just be a pedestrian post legal victory sit down. Then she spoke about the daily threats to her and her family by the MAGA cult. Her daughter was doxxed. Heck they even went after her horse. Her financial situation deteriorated. The comparison to the E. Jean Carroll case was instructive. She won in court and is being duly compensated. Stormy, not so much. Glad that she is raising some money from her go fund me account.
No, the “at most” version of that debate performance was that it showed he is a brain-addled old man who is no longer fit to hold the office. The “at best” version is that he had a bad 30-90 minutes. I’m entirely receptive to the latter argument, but here we are, seven days in, and he’s doing nothing whatsoever to prove it was an aberration.
…nothing whatsoever, besides continuing to run the country.
I reject this Trump-serving attempt to shift the burden of proof onto Biden. Until Team Biden says there is a problem, there’s no problem.
Demanding Biden come out and perform physical vigor until every observer declares themselves satisfied – which is what you propose – is exactly how Team Trump intends to wear Biden down.
Call me when Biden makes a bad decision and one of his aides blows the whistle.
It’s a real problem. Many of my hard core Dem friends are very unenthusiastic about him both before and especially post debate. My partner, normally very progressive, just thinks he’s a doddery old man. It’s very hard to convince people to not believe what their eyes see. I love Biden and think he is the most effective President in quite a while but even I am getting some niggling doubts. Not sure what the answer is here, but hiding in a basement somewhere sure isn’t it.
I’m intrigued by the idea Josh Marshall noted from a reader email about essentially getting all high profile Democrats out on the trail and saying we have to do this together, it’s not Biden vs trump (spit) but all of us against trump and trumpism. It’s always been a team, and the stakes are enormous, existential.
They can highlight project 2025, all the terrible things trump has said he will do, and go from there. Emphasize the ‘pres is not a king’ aspect.
Dunno, maybe some strategists smarter than me can make this into an opportunity
Perhaps the six pathetic Bent Supreme Court Nobs should be introduced to our Declaration Of Independence. They seem to have missed that one in law school, their undergrad studies and indeed in their primary grade school education.
He (the King) has made Judges dependent on his Will alone, for the Tenure of their Offices, and the Amount and Payment of their Salaries.
