Originally published at: Supreme Court Hears Major Trans Rights Case
A red-letter trans rights case comes to the Supreme Court Wednesday, one that could have ramifications for sex discrimination more broadly if the right-wing supermajority sides with Tennessee. Skrmetti v. U.S. is nominally about Tennessee’s ban on gender-affirming care for minors, an echo of laws passed in many red and purple states. Biden’s Department of…
First…somewhere.
So, a group of religious fanatics on the Supreme Court hear a complicated case involving human sexuality where a group is demonized because they are 1) a minority and 2) misunderstood 3) the latest right-wing bugbear.
What could possibly go wrong?/s
“Rational basis” review = The state can do whatever it wants.
(But for one or two Kennedy gay rights opinions from the 90s, including the Colorado discrimination amendment case.)
Of course he did, shades of Dobbs.
Uh Oh: Roberts Opens With A ‘Shouldn’t We Leave It To The States?’ Argument
But her emails.
Sotomayor has no patience for Alito.
She’s systematically picking apart his arguments that gender-affirming care is actually very dangerous and that this case has no relation to Bostock .
and Kagan nails it.
“what’s really going on here is discrimination against and a disregard for young people who are trans.”
All performative BS. Trump just won an election based on the hype surrounding issues that affect less than 1 percent of the population.
This is what the churches are for - never ending culture wars.
Chicken pox is very controversial. Why shouldn’t we leave it up to state legislatures to decide whether children can be inoculated against it?
Why is it Democrats have to play the vanguard on an issue that only represents about .05% of the population? There’s NO political upside. It’s all downside FFS. It feeds right into the Republican narrative. Why Democrats embrace this ‘issue’ with open arms, as if it’s a critical major discrimination issue is hard to figure. It’s not even on the first page of yellow pad importance to 99.5% of the American public who have far more serious issues to confront everyday. But of course it’s a Democratic Party issue. Why so?
It is of great importance to the .05% and should be addressed openly, but politically it’s a big loser. It resurrects high school ‘bathroom’ issues and creates chaos. How should we respond to the Republican narrative when they ask, why should a male, with at least twice the muscle mass of a female, be able to compete on a high school girls’ swim team? Not all that important in the scheme of things, but to the MSM it definitely is, as it continues to stir the pot of division w/o the Republican Party having to do anything. But they’re the stoopid ones.
SCOTUS is primed to the “leave it to the states” angle on trans rights? This will encourage suits challenging Obergefell, Loving, Lawrence and Griswold. Eventually those, too, will be left to the states, courtesy SCOTUS rulings. Every one of those won rights will be challenged by MAGA/Federalist lawyers, litigated up the ladder, and SCOTUS will throw it to the states to decide. You want to marry your same sex partner? Looks like you’ll have to move to do it.
Republicans: Trannies! Trannies! Trannies! They’re grooming your kids! Sex change surgeries in fifth period! Sex changes for illegal immigrants with your tax dollars! TRANNIES!!1
$200 Million in Political TV Ads: TRANNIEEEEEEESSSS!1!!
Some Dem Pol, Somewhere: I think we should treat everyone with kindness and equality.
Republicans: OMG, you never fucking shut up about the trannies! WTF is wrong with you, you sick fucks? You’re totally obsessed with the trannies! See, I told you they’re cuckoo for tranniepuffs!
Remove the source of the controversy, just make the vaccine illegal.
Dr. Phil and Dr. Oz and Bobby Jr have the studies to prove it’s dangerous.
Aren’t there a helluva lot of “It only affects .05% of the population” cohorts? 85% of all rare, “orphan” diseases affect less than one in a million people. If Republicans stripped medical research funds for those diseases, because so few people suffered from them, would Democrats fighting to restore those research funds constitute an unwise political decision? You know, because so few people would get screwed if they just let it go?
Branding is what Republicans do best. They understand the importance of it. Democrats dismiss it as sleezy political tactics that have no place in American politics. Didn’t the ‘trans kids’ conversation/legislation make it to the front page during the Trump presidential years?
Is gender affirming care for teenagers the hill Democrats want to die on. It is a small social issue that gives right wing yackers something to talk about. Not many impacted.
Why can’t we pick a bigger issue that improves the lives of millions of people. Increasing the money paid for education comes to mind. How about improvements to social security. We need to stop playing small ball.
He asks whether the “medical nuances” of the case don’t “make a stronger case to leave the determination to the legislative bodies?”
This from the Court that is putting itself above all regulatory agencies. Basic legal reasoning goes out the window when you become a zealot, I guess.
Vote Democrat, the party of wise, deliberative triage!
Republicans: Drag Queens are eating your dogs, they’re eating the cats.
Some Democrat, Somewhere: ???
Republicans: TRANNIEEEEEEESS!!! I told you, they’re totally obsessed with the trannies! They won’t ever fucking shut up about the trannies! It’s the only thing they care about! Imma gonna go spend another $200 million on ads about the trannies getting trannie surgery in illegal immigrant detention paid for by YOUR TAX DOLLARS because this hate session IS SO GOOD FOR US. TRANNIES!!!
