Supreme Court Hears Effort To Curtail Blue State Abortion Access – TPM – Talking Points Memo

The Supreme Court’s dedication to the “leave it to the states” theory of abortion access will be tested Tuesday, as the justices hear a case in which anti-abortion doctors attempt to make the abortion drug mifepristone harder to access nationwide.

Here we go, folks. Expect certain members of SCOTUS to flail about and compare it to hunting witches in Salem. More old, white males who might be confronted with the horrific possibility that someone needs medical help after taking mifepristone! And then show up where they might be forced to do medical “stuff” that offends their sensibilities. So much woulda, coulda, shoulda.

Oh, but all these good “Christian” judges (mostly, but not exclusively men) must surely know more about medicine than those experts with years of actual knowledge and experience. I call bullshit.

According to the NYT, Josh Hawley’s wife will be arguing the case for the plaintiffs.

If right wing SCOTUS majority curtails access on this one, that will guarantee a massive Blue Wave come November. And that will put them on notice that their days of a nine member court are numbered.

Absolutely agree with the first part: GOP strategists (however few of them are left) must be shitting themselves over just that scenario.

Can’t agree with the second, though: I’m not sure that Dems have the git to make an expansion go, and I’m 100% certain that both Thomas and Alito are way too arrogant and disconnected to comprehend that an expansion could ever occur.

Yes, probably so on 2nd part, I was just feeling cocky on that one.
Perhaps a massive Blue Wave will at least encourage a retirement or two.

Also, with Roberts favorite wheelhouse being Interstate Commerce, I’m curious to see what he does here.

I wonder how the Justices are going to try and thread the needle so their ruling only applies to abortion drugs and not boner pills.

One of the things that worries me is the growing practice of nutbar lawyers including factual assertions that are simply false in their pleadings. And those assertions then become part of the judicial version of the world. There should really be some sanctions for that. (I know that there are in theory, but I mean in practice.)

Take a look at the picture of Justice Ho’s wife in the Guardian article.

“Ho’s wife, Allyson, moved into her husband’s position and his old office.

“Meet the Hos.”
Yes meet them. That sentence can have many meanings.

She’s laughing but you can imagine what she’s thinking “Yeah, stick it to the lib hussies with Comstock” “If a woman is hemorrhaging in a parking lot she’ll learn her lesson”.

Maybe someone will keep digging into their finances, or find that kiddie porn on their hard drive.

Messianic types that are hungry for money and have the kind of malleable opinions that get them on this court are knee deep in squalor.

We missed an opportunity. Putin has the kompromat we didn’t find look for.

They’re doing the corruption right out in the open. As long as the money goes to the spouse of a sitting judge instead of directly to the judge, it’s apparently OK.

This may be a case where they try to kick the can down the road and take another swing at it after the election.

The last thing they need is to make the November election a referendum on SCOTUS.

Not that it isn’t a big issue already.

But it sure does take the focus off of Biden’s age.

Yes …
There are individuals with education - entirely in the field of law … who are unwavering convinced that they know more about medical science and clinical research than those who have been immersed in the field for 50+ years

She’s been the lead lawyer on the case from the beginning.

I think that’s more likely with Mike Johnson. He just has that creepy youth pastor vibe. Even before you get into the Seven Mountains theology.
