Maybe the court’s 2016 composition would have needed to be decided in 2018, but i double dog dare anyone to suggest that HRC n Trump are identical twins.
Same goes for the ‘Bernie woulda won’ crowd.

Didn’t the Supremes have the option of remote work in issuing this ruling? health for sure for me, but maybe not for thee…
Right wingers will grab at any justification for their authoritarian actions and beliefs. The aren’t anchored to consistency, reason, or empathy. Only the exercise of power they reserve exclusively for themselves.
Their slide to irrelevance accelerates.
a “workaround” for the administration’s inability to get a more comprehensive ban through Congress.
Wow. Republican recalcitrance is Biden’s fault?
Dont hold me to it, but with the exception of Sotomayor, every justice was in the chamber.
Even worse, I think txlawyer got it right with the ‘pick & choose’ doctrine.
From currently available information, the U. S. could reach 1 million deaths from Covid in about 75 days - 2 and a half months, at current rates. Just in time for April Fools day. And the GOP Scotus doesn’t give a shit.
So, OSHA can’t enforce its workplace safety mission.
Does this mean that my lab manager can, finally, open up our lab’s benzene containers? Ever since we’ve been following OSHA’s rules on benzene containment, I’ve missed that sweet smell.
Oh yeah, and down at our local Applebee’s, the franchise owner has been agitating that because line cooks must wash their hands EVERY time they go to the bathroom, he’s losing valuable profits to their lack of productivity. And that their freedom to urinate on their hands is being infringed upon.
Meaning all of the regulatory agencies now have no authority to regulate anything the SCOTUS says they can’t?
And the Executive Branch is now de-fanged from pretty much any governance?
And Congress is now in charge of everything?
Just a straight answer, please - this is a legit question and not doomsplaining (which is not even a word and shouldn’t even be a discussion point).
For now
And you can forget bans on smoking in restaurants. How dare my lungs infringe your right to enjoy a soothing cigarette.
After insisting thrice, almost biblically, that he wasn’t saying the vaccines are unsafe, Justice Samuel Alito claimed: “Some people who are vaccinated … will suffer adverse consequences.”
This fucking argument drives me crazy. It’s like saying the kitchen’s on fire but don’t use the fire extinguisher because some of those chemicals could cause cancer.
We should be so lucky for the basis to be “arbitrary”. I think we all know that the real basis will be to strike down democratic actions and permit conservative ones.
Experts, having tracked a growing hostility in the rightwing judicial world to agency authority, characterized these arguments as an indicator of how aggressively the conservative bench would stymy the Biden administration’s attempt to make policy unilaterally.
Yet, under any Republican President, there would be no argument against the use of such unilateral authority.
Precisely. There should be no sigh of relief for the healthcare side of things.
pending further arguments
Doesn’t bode well for it.
I’m guessing their arbitrary declarations won’t be quite so arbitrary. Predictions can probably be based on whether it’s a Republican or Democratic administration regulation. And, what does big business prefer.
There’s a difference in that versus how they’ve handled vaccines previously.
Where addressed, vaccinations have been required to be offered to certain employees in certain situations, but no requirement has been on the employee to take the vaccine.
So this is new territory they’re into.
Objectively, the Supremes are opportunists and assholes, but they’re not necessarily out of line to find this unconstitutional.
And the real guilty party is Congress, who could make the whole thing moot today by passing a vaccine mandate bill. Unfortunately, they’re on break, again.
They’re trying to run out the clock hoping that things are much better when this comes up again and they can claim the mandates are no longer necessary.
I’m not a lawyer or a math dude (i wish i was either now), but i don’t have faith in five (arbitrary #) ‘Minos’ who don’t know the difference between the flu and cv-19 (Gorsuch).
