The case is considered a legal longshot for the administration.

After the election but before the inauguration and a decision too late to restart the census to insure a complete count. Sorry but no matter how they rule, the credibility of the court is toast.

A 6-3 right wing extremist majority, including Amy Covid Barrett, makes it possible the Constitution may be rewritten to allow the Trump regime to literally not count all persons, in direct violation of all prior censuses and the law.

Will they do it? If so, this ensures Biden adding justices to the Court and bringing it back into balance — and revisiting this decision.

Trump is seeking to remove undocumented immigrants from the count used to determine how many House seats each state gets. Doing so would allow him to shrink the congressional representation of immigrant rich states while boosting the electoral advantages of whiter, more Republican-leaning parts of the country.

If SCOTUS rules that Trump can unilaterally exclude immigrants, why can’t Biden simply reverse course and unilaterally include them?
