You’re not going to believe this but…AP took him to court. And won. It’s wild. Almost like capitulation isn’t the only option. Somebody tell the Columbia board of regents.
Didn’t Kafka write a story about Abrego Garcia?
He wont be for long. He will be murdered to moot the case. There is simply no way Abrego Garcia makes it back to the US.
The chances of Abrego Garcia to be alive in two months are not much better.
Exactly. You have to wonder why the court order wasn’t “return him to the United States immediately.” Were they too afraid he’d ignore them?
Rubber barely met road here if you ask me. “Facilitate” is practically begging for dilatory shenanigans and hand waving resulting in “well, we gave it a shot, but you know how these things go…” We’ll see I guess. I think maybe they decided they wanted it to be unanimous…felt it would be important to send that message about whether it’s ok to do this kind of thing without due process…but had to water it down for Alito and Thomas and maybe others to make that unanimity possible. Issue will soon enough be what is sufficient for due process and how much they can make inroads attenuating its scope.
Alito in particular will want his shot at taking an axe to anything defining “facilitate” or “effectuate” in a manner he thinks might risk making such orders effectIVE. After all, “facilitate” from the SCOTUS is a clear step down from the lower court’s “effectuate” if you really think about it. Sort of the difference between “HELP it happen” and “MAKE it happen.”
Meanwhile, everyone knows all the US would have to do is say “have him ready at such and such time and we’ll be there to pick him up” and it would be done. So when/if it doesn’t happen, all holy hell should break loose.
Eventually, they’re going to give us a new Crispus Attucks and the question will be whether we recognize it when it happens and react accordingly.
This is good. I am surprised he complied. I think AP will call it Gulf of America and American Ocean after this experience. Canada will be North USA and assigned the zip code NU.
Legal nihilism is tedious and earns you no answers about why your tedious bad-faith question is tedious.
“All Deliberate Speed”
Indeed. CJ Immunity and the Fascist Five’s motto seems to be: Leave no mistake unrepeated.
I think the fuzzy language reflects the Court’s wish to avoid any suggestion that it’s crossing the line of the separation of powers. And the 9-0 vote is a clear signal to the Trump regime that a few days’ delay is all it’s going to get in this case from SCOTUS. In effect, “Make this go away and don’t bring it back here! This is the worst possible case for you to press for a broad expansion of law, with an acknowledgedly mistaken victim. You’re not going to get even a base on balls with this one.”
Problem is that it has set up all kinds of new issues to litigate, i.e. new opportunities to overrule precedent and set due process and other legal standards that facilitate this re-whitening project.
The decision does clearly direct the Trump administration to move to return Abrego Garcia, who was deported on March 15 after the government mistakenly ignored an immigration court order barring his removal.
Uh, what? “Mistakenly” ignored a court order? I expect this kind of minimization from MSM, certainly not from TPM. There is absolutely no evidence that it was a mistake, and lots of indications that it was done with forethought and planning.
Be better.
Yeah, that’s a strange way of spelling “willfully”, isn’t it?
If Trump says he can’t get Garcia back doesn’t that mean he is a weakling and El Salvador’s President rules him?
I don’t think a year ago you could find a single mainstream economist that would have foreseen a flight to “safety in Greek bonds” because the US 10- and 30-year treasuries were somewhat riskier. In Europe, the latest market manipulation is already known as the “Trump Pump”, implying intentionality. But, oh yeah, nobody in charge of the SEC at the moment. I saw this comment by Brookings Justin Wolfers:
“The U.S. is in the middle of two economic crises. One is being caused directly by tariffs. The other is a crisis of confidence being driven by a crisis of competence.”
The problem for me is that this is both deliberate and crazy. Ukraine is now about the “coalition of the waiting” and it’s off to war with Mexico next week. Great tv, but sucks as policy.
So could the court order Noem to go talk to Garcia?
IMO they did supply the answer. All Trump has to do is ask El Salvador to send him back. I believe the hand written letter by Trump, was put into a bottle in the Gulf of America, in the hope that it would eventually reach El Salvador. It won’t be Trump’s fault if the Chinese grab it on it’s way through the Panama Canal.
Let the musical chairs begin. A couple days ago I speculated on whether it would be a) Bessent, b) Navarro, or c) Lutnick who would be the first to go. Apparently, b). So who goes out in the next round?
There’s no reason to be rude.
