Because Abbott is a rich white Republican governor in a state overwhelmingly controlled by a rich white Republican minority and owned by lunatic white Republican billionaires. It has fuck-all to do with “justice,” it has to do with power and propaganda.

Going to disagree, but I understand your point. Federal authority over the National Guard shouldn’t be in question. They aren’t there to be The Governor’s Praetorian Guard.

I think this is just another data point indicating that the most right-wing Supreme Court justices are on a mission to diminish federal power.

Here, the four dissenting justices would have had the federal government cede its national border responsibilities to the Texas government.

In the upcoming case regarding Chevron deference and agency power, they will likely be joined by what passes for centrist justices (in this sad age) in diminishing the power of federal agencies to enforce the laws passed by Congress.**


**Technically, the justices will say that they are putting that power back in the hands of Congress where it belongs. But for most of the last century, Congress has not had the time or the competence to decide the kinds of issues that agencies, with their expertise, regularly deal with.

That is even more true in the present environment, where a minority of representatives and senators can prevent the Congress from doing almost anything — even the very basic actions that are necessary to keep the government functioning.

Sounds like counsel to roll over and do nothing. Who gives a fuck whether Abbott wants to eat his cake and have it, too, or is cosplaying for billionaires? The fact of the matter is he’s attempting to nullify federal law and federal jurisdiction, same as John C. Calhoun tried to pull in the 1830s.

100% agree with you–and respect, from a never-served civilian, for your boots-on-the-ground experience.

I think Biden might could get to a place where he sends in NG, the way that Ike did, but for good or for ill (I’m agnostic, because I’m neither a border expert nor a political strategist) I don’t think Joe believes the crisis is there yet. Let us remember that, at least for now, the WH won this round.

I can understand why Johnny the Robber Baron voted with the Biden Administration; he is a Corporatist who values cheap labor. Strip Search Sam, Clarence the Corrupt, the seat stealer with a grudge and the Drunk is pretty much expected as well, they want to weaken the administrative state.

But Barrett the Hand Maiden siding with the Government? What is her motivation? Seems to me she would be a solid 5th vote to side with the Texas Gov. Weird.

Neither side gave a reason for permitting the feds to remove the wire?

The 5th Circuit order included an exception which allowed Border Patrol officers to cut the wire in medical emergencies. The Biden administration said that Texas was violating that provision.

The WaPo story has a little more detail on this emergency wire cutting nonsense. The DOJ argued that having to wait for the barbed wire to be cut might take too much time in an emergency situation such that more women and children crossing the Rio Grande would drown. I suspect that it was this argument which persuaded ACB, the mother of seven children, to side with Roberts to get to the 5-4 decision. The four male Republican justices voting to keep the razor wire in place are simply sadists.

I wonder how this will impact Texas’ decision to string concertina wire along the New Mexico border.

I haven’t heard that Abbott had it removed, so I’m assuming it’s still there. To be fair, I haven’t heard of any serious problems with Texans fleeing to New Mexico since it was installed and I do believe New Mexicans should welcome with open arms any Texans wishing to flee the state.

The Constitution forbids states to interfere with interstate commerce. Barriers between states would seem to be unconstitutional?
