Schumer Says Giuliani Has An ‘Obligation’ To Testify After His Associates’ Arrest

Senate Minority Leader Chuck Schumer (D-NY) on Thursday declared that Trump lawyer Rudy Giuliani must testify in front of Congress after two associates involved in his Ukraine-Joe Biden scheme were arrested.

Welp. Lindsey Graham demanded Rudy be given the chance to “tell us what he knows” on the Senate floor. Given this latest development Ill bet that shit never happens. Lindsey’s going to have a change of heart.

I wonder how long Chuck’s been waiting to kick Giuliani in the balls. Now he’s got a three-fer shot, plus all the taunting he can dish out.

He will testify as long as he has immunity and does not have to answer questions. He will go in and just read a crazy statement. Kind of like every news interview he has done.

Lindsey might have to do a little more ‘ball washing’ next time he’s on the golf course with Trump.

Although, it might have been stable genius’s idea for Lindsey to put out the invitation to begin with.

That and a buck fifty will get you a lousy cup of coffee.

An obligation to testify under oath will set off a tidal wave of attorney-client privilege claims.

There is no “obligation” to testify. There are subpeonas to testify. And the sooner the house gets off the pot and issues those subpoenas and then goes to the Chief Judge of the DC circuit - who I believe would handle any issues with enforcement - the better.

And btb, that judge is Judge Howell. This judge: https://www.washingtonpost.com/local/legal-issues/us-judge-balks-at-justice-dept-bid-to-deny-house-access-to-mueller-grand-jury-materials/2019/10/08/bd0de590-e9c6-11e9-9c6d-436a0df4f31d_story.html

And the other reason to use subpoenas is that there is no applicable privilege when someone is forced to attend - i.e. you can’t claim attorney client privilege. The house is the sole judge of the rules that apply. The house can make someone testify - regardless of the privilege. This is a good historical primer on this: https://www.justsecurity.org/66534/white-house-letter-distorts-both-law-and-history-on-impeachment/

Well he can talk about his lunch with the two guys…at Trump’s hotel in DC and just hours before they tried to haul ass. Of course no one mentioned anything about 1 way tickets the hell out of here.

And the Chief Justice of DC Appeals? Merrick Garland.

Schumer? Didn’t I see something about a memorial service for him? Something like that, I think, because he seemed to have disappeared from Congress without a trace.

You’re the fucking Minority Leader, Chuck; if you didn’t want to do your damn job (which includes being the face of the Demon-rat Party, not just the “behind the scenes” stuff – although who knows if you’re even doing that), you should have let Dick Durbin take the job.

Too bad Merrick’s not on SCOTUS. He couldn’t touch this from there.

I think any appeal to the DC circuit would go “on the wheel” and be randomly assigned to a panel of three.

But issues with subpoenas go to the Chief Judge (at least that is the usual practice, I’ll see if I can look up the rule) at the district court level.

Dear Josh

I’ll pay for a yearly subscription, if it includes a sarcasm font.

Thanks in advance

That’s the sound of a trap closing…Graham and Giuliani thought they were so smart, putting Giuliani up to show what “honest” testimony would look like compared to the Democrat’s “kangaroo court”. We all know that was BS, but it was an attempt to muddy the waters, and it’s not even clear Graham was serious about putting him up, especially with Harris and Klobuchar sitting there waiting to question him.

Now though, it’s backfired…if Giuliani doesn’t testify under oath he’s showing he’s afraid to do so, and adding to the picture that it’s a cover up. If he does, he’s shredded for this by the Democrats, and no amount of Republican fluffing will help cover his tracks. Again, these guys are really dumb, which is a good thing as it might save the nation.

Unfortunately, can you possibly imagine how little they care about appearances. They haven’t until now.
