Raskin should go ahead and subpoena Trump and let him invoke the Fifth Amendment due to the possibility of criminal charge against him related to the subject matter of the impeachment. Failing to subpoena him gives the defense room to argue that no adverse inference should apply because he never invoked the Fifth (which is what gets you that adverse inference in a non-criminal case).

Raskin offered any date between Feb. 8 and Feb. 11 for Trump to testify.

If he goes for it, on the 11th Twin Peaches will offer to testify on the 12th, and will show up an hour late.

Should they wait to subpoena him until he decides not to cooperate? What do they lose?
Oh and can the impeachment managers subpoena him or would it require a vote from the House or Senate?

ETA: I really don’t know if these are settled items for an impeachment trial in the Senate.
