En banc review. YESSSSSS!

(Courts tend not to grant petitions for en banc review, and those that they do grant are not granted lightly. My prediction is that the full appeals court has, at least in principle, a majority prepared to overturn the three judge panel and return this to the district court. Discovery is going to be an absolute hoot.)

Here is the Seth Barrett Tillman, the lone for-Trump amicus listed above, looking totally sane.

His services seem to be in such demand in America that he now teaches in Ireland.

Other legal scholars regard him as less than careful.

In June, Mr. Tillman filed saying that some framers of the Constitution did not think the emoluments clause applied to the president. One of his key pieces of evidence was a document signed by Alexander Hamilton.

The reaction was swift and brutal. Legal historians and a lawyer for members of Congress suing Mr. Trump said Mr. Tillman had misunderstood, misrepresented or suppressed crucial contrary evidence in a second document.

In another blog post, Brianne J. Gorod, a lawyer with the Constitutional Accountability Center, which represents lawmakers suing Mr. Trump, said Mr. Tillman’s account was “not accurate, not even remotely so.”

the original three judge panel consisted of one (current) Trump judge
One (current) Pappy Bush judge
Once (senior) Junior Bush judge.

Of the 15 currently serving (non-senior) judges on the 4th circuit, six were appointed by Obama, and three by Clinton (three by Trump, 1 each by Reagan, Pappy Bush, & Jr Bush)
