Flynn should be wondering why Donnie 2 scoops haven’t pardoned him yet, and whether a pardon is coming. If the DC circuit chooses, this can drag out past November before a decision, a decision in which the judge can rule to dismiss all charges without prejudice.

In which case Flynn might be begging for mercy come January 21, 2021.

The theatrics are always the same: project your own sins onto others (assault on the rule of law), repeat the Big Lie endlessly (Deep State conspiracy) and wrap it all up with indignant rage.

That is precisely what Flynn wants. There will be no pardon before november, but the preznit can pardon any time he wants, regardless of conviction or sentencing status.

If a defense counsel said “my client is guilty” and stopped presenting a defense, would a judge be constrained from appointing new counsel?

The whole process here is a complete sham. It is an attempt to give Flynn a virtual pardon without Trump taking the heat for the pardon. That is it. Everything else is window dressing.

No, The last thing Flynn wants is to have this dragged into the next administration, as Trump isn’t stupid enough to pardon him. A pardoned Flynn can be compelled to testify against Trump without 5th amendment protections.

If the court dismisses without prejudice, the next AG/DOJ can refile against Flynn. AND NOTHING SHORT of a pardon can head that off.

We are getting close to “precious body fluids” being used as an excuse to dismiss the case.

It does not work that way in real life, as was demonstrated by NONE of the SIX pardoned during the Iran Contra coverup being compelled to testify, even though we had an active special prosecutor investigating.
