The federal judge who is handling the extraordinary proceedings in the Michael Flynn case told an appeals court on Monday it should not yet intervene in the matter, as Flynn is seeking.
Judge Sullivan is not the one who should be defending his actions in this matter.
Other than the fact that one of the three judges (Naomi Roa) is a fascist boot-licker Trump appointee, and another (Karen Henderson) is not a honorable HW Bush appointee, but a political one (Henderson was the slightly less honorably hack that voted to overturn the House Subpoenas for McMahan to testify) this would be a slam dunk. There is no grounds for review at this time.
Lets see how Political Henderson will be (you can count on Roa to be political) or if the rest of the DC Circuit needs to step in.
And a P.S. on the filing. I find it notably how the subject of Turkey, and the false statements regarding him being a paid agent of Turkey while working for Trump, comes up several times. I do not know how this filing came about (it is very odd for a judge to make a filing like this) but clearly someone - probably Judge Sullivan - decided to highlight Turkey, which is a big and perhaps even worse part of this than Putin (at least in the public record we know about).
The reality is that Flynn sold out the US to Turkey for $$$$, his sidelining on Russia was either (a) a payback expressly to Putin for his help, of (b) aligned interests, but the first is actually worse, and easier to prove.
Yet another Trump disaster unleashed on the country.

Fortunately, there are still a few people trying to hold this country together for the next 8 months.
Judge Sullivan is fair, inquisitive and a truth-seeker. That is precisely the kind of judge true Americans want and trust. He is absolutely right about having an adversarial contest about the way this issue shakes out. And, as the motion to the Appeals Court notes, Flynn may yet get the relief he seeks–it’s an open question. Seems fair and transparent. If Flynn gets off, no one will say the process was rigged.

I concur with this. Simply, Flynn pled guilty to lying and was convicted. Judge Sullivan should not simply dismiss this plea and conviction because Flynn changed his mind and got his corrupt friends in the DoJ to back him up. Flynn should be sentenced by Judge Sullivan forthwith. If Flynn elects to appeal, just like any other defendant, he has that right. This is not rocket science.
This is a very good brief, even for having the law and the facts firmly on their side. And I’lI definitely be stealing the move in the Table of Authorities identifying the chief authorities with asterisks.
Fun fact: Kosta Stojilkovic was a law clerk for John Roberts at both the DC Circuit and the Supreme Court.

Convicted, just not sentenced.
He was, for some of his crimes but not all.

All too true, but we should urge and encourage Judge Sullivan to stand his ground., lest Barr & the DOJ sense a new freedom to manipulate and skew our justice system.
Flynn LIED. If you read the information that was released to the public there is no question. We know what this is about and it is infuriating that tRump is defiling the office of the Presidency to get criminals from facing consequences they so richly deserve. It was this judge that said Flynn was a traitor and he is. This makes me sick!
Just what Team Trump needs on a day with unprecedented unemployment, the worst virus epidemic in 80+ years and substantial civic unrest.
That’s the entire point of the appeal, to avoid the DoJ having to defend their actions in front of Sullivan…they want to get away with this travesty without any publicity. Good on Sullivan for holding their feet to the fire, though I’m pretty sure that the fix is in and Flynn will go free, the question is just how it will play out in the end.
