Seditious conspiracy sounds pretty metal, but keep in mind that the charge doesn’t carry any more prison time than the obstruction of an official proceeding charges they were (and still are) already facing. It’s also been pretty difficult charge to win against white defendants, historically speaking. But it allows prosecutors now to present all the evidence that these assholes were literally trying to topple the United States government. That’s kind of a big deal, and I don’t imagine it will go over well with your typical D.C. juror.

I don’t know, but it should be noted that the courts made Sheik Omar Abdel Rahman’s seditious conspiracy sentence non-consecutive of his other charges, such that his terrorist ass isn’t ever getting out of Supermax. Don’t discount that as a possibility for the J6 sedition defendants.

ETA 2: Best term is “consecutive.” What can I say, I mostly don’t do criminal law.

Good thing they didn’t charge them with only seditious conspiracy:

In addition to seditious conspiracy, prosecutors charged the five with assaulting federal officers, destruction of government property, abetting civil disorder, conspiracy to block government officers from discharging official duties, and obstruction of official proceedings.

Seems like the DOJ is covering all their bases with these indictments.
