I think Collins is more likely to resist a nomination if she loses than if she wins, though.

Assuming Dems take the senate, they should eliminate the filibuster and add three justices to SCTUS to neutralize what happened under Putin’s candidate, plus three extra to put in place the three majority Hillary would have had, plus two extra for good measure and to keep the total an odd number.

So, assuming Biden win AND senate in Dem hands, new SCOTUS of 9+3+3+2=17 justices.

What we are likely to get if the GOP is a Supreme Court that actually intervenes very little, with the big stuff never granted cert. For example, we will never get to read RGB’s opinion in Juliana, because that case was dismissed by a 9th circuit panel just on the cusp of our first covid spring and before the west coast wildfire summer. The Stanton dissent asks if not now, when? We already know the answer of a conservative SCOTUS - ā€œNeverā€.

This is why the Senate, with it’s trend toward 2/3 of the senators actually representing only about 1/3 of the populace, is as obsolete and troublesome as the electoral college.

I actually remember 2016. They didn’t just say they wouldn’t let Garland have a hearing until after the election, they said that if Hillary was elected they could keep that seat open for 4 years if they wanted to. Like I said in a separate post last night, the anti-abortionists alone are going to demand that this seat be filled immediately.

This also highlights the issue of lame duck politicians who have lost their races being able to burn the fields before they leave, like several Republican state houses have done in the recent past. Are we waiting months after the election for the transition of power so that they can make it across the country on horseback? IN the meantime, I fully expect the Republicans to seat someone no matter what happens in the election, said the frog to the scorpion.

The Republicans will gloat and do their best ā€œMr. Burnsā€ impression ā€œeeeeeexcellent!ā€ and proceed to destroy Democracy and piss on the constitution in the service of their true masters: the multi-national Oligarchs (including Putin and Bin Salman.)

There is NOTHING the Democrats can do, thanks to the ā€œpurity policeā€ who refused to vote for Hillary and other Democrats in 2016 and 2018 because they were not ā€œwokeā€ enough and either stayed home, or voted for stalking-horses like Jill Stein.

Now, we are consigned to at least 30 years of hyper-conservative, hyper-religious SCOTUS rulings that will set us back to the 1920s in all things: Religion in Government, Race relations, Voting rights, reproductive rights, Gay marriage, gun control, you name it. The Fascists will have their 5-4 vote on each and every one of these issues, 6-3 on most.

Our ONLY hope, is to MASSIVLY GOTV this time and smash the Republican Party with the Blue Tsunami like was done in 1932.
FDR also had a Conservative Majority on the SCOTUS opposing him every step of the way and they struck down many of his more progressive programs, but he still got Social Security, and many other protections through with the help of a veto-proof majority in the House and a solid majority in the Senate.

WE NEED THAT AGAIN for Joe Biden and Kamala Harris to overcome this tragedy.

DO NOT GIVE UP.
USE THIS set-back to strengthen your resolve and WORK EVEN HARDER to protect Democracy from the Fascist Menace.

Oh, it’s a classic ā€œheads I win, tails you loseā€ gimmick.

If POTUS is a D, there’s a chance the election will reverse that, so hold out. That was the play in '16.

If POTUS is a RRR, there’s a chance the election will reverse that, so either to act right away, or see how the election goes and if Turnip loses, confirm during the lame duck.

Personally I think McTurtle can’t actually pull this off before Nov. 3 because he won’t have his full caucus on board. Graham has a strong challenger and Black voters in SC are fired up, so little Lindsay is shitting his pants right now. It makes more sense politically to dangle this in front of the RRR white and conservative Black so-called Christians because nothing motivates them to vote like SCOTUS in the balance. It worked last time, without the vacancy held open in '16, Turnip would not be POTUS.

That’s all assuming the winner is decided by the certification deadline. If not, then the nomination will be used to incite MAGAt’s to riot.

McConnell just makes up a new ā€˜rule’ when he wants to screw someone over. Situational ethics reign supreme with ā€˜professional conservatives’ or just plain Trumpsters. They flat out don’t care. It is way past time for the Democrats to go scorched Earth. IF you want to do this you rotten liar we will add more seats to the Supremes and pack the court. We will change rules of the Senate that have remained sacrosanct. You have lied and schemed and shrugged for the last time. Watch out…DC statehood is coming at you.

Not to mention all the other Obama judges they held up in lower courts that Trump ended up filling. Mcconnell played dirty and it worked. If the Dems sweep the election they have to actually DO something or we’re right back where we started in 2 to 4 years. Trump and the Rethugs have carved out enormous power for themselves so we need to take it and use it or lose it. We already know the R’s won’t hesitate to do the same.
