Pennsylvania House Democrats are in an uproar after finding out that state Rep. Andrew Lewis (R) only told the Republican caucus about his positive COVID-19 diagnosis.
First, this was unconscionable on the part of the gerrymander party. Second, given the high death toll in pa, and now spread into Republican rural area. This is a good hammer to use.
Republicans made Covid-19 political with their Anti-mask and re-opening, and granniesâ gotta die for the Dow campaigns, And having gone there they need to be made to pay for taking wing-nut stances on something that 85+% of people are justifiably scared of.
Criminal. You donât withhold life-and-death information from people based on political party. I donât have words to express my disgust and outrage.
There seems to be a huuuge case of pass the hot potato in the PA Republican caucus. First Rep. Lewis didnât man up and inform the whole legislature of his infection. Second the leaders of the Republican caucus are trotting out HIPPA, which I will admit to not being knowledgeable about the legal points, but Republican leadership are not medical professionals, and second they are not Rep. Lewisâ employer.
Some of us remember the 80âs when you had some Republicans freaking out and calling for the forced quarantine of AIDS patients. Now itâs we donât care about communicative disease at all.
HIPPA only means that your medical information cannot be shared or disseminated without your consent. It is not a non disclosure agreement. This man had every obligation to inform his colleagues, but chose to put them in danger of exposure.
I quote Chapter 27 - Assault - from the PA Criminal Code:
§ 2705. Recklessly endangering another person.
A person commits a misdemeanor of the second degree if he recklessly engages in conduct which places or may place another person in danger of death or serious bodily injury.
Seriously doubt HIPPA or any other rationale will excuse Republican leadershipâs unethical conduct. This was an assault, and should be prosecuted under the same laws as AIDs carriers who engaged in unprotected sex w/o notifying partnersâ
HIPPA law is a tattered fig leaf for these people. That law applies to medical institutions/personnel. so that confidential patient information is not shared w/o the personâs knowledge or consent. This would not apply in the case of infectious disease, for which there are laws mandating reporting. I used to do STD contact tracing, so most likely this is a violation of laws or regs. Of course, the repubs donât care.
There is no prohibition against ME making MY medical information known to anybody of my choosing. And Rep. Lewis could have shared the information with the speaker, who could have then informed everyone potentially exposed without naming names so they knew to isolate and get tested.
