Ohio Supreme Court Rejects Gerrymandered Legislative Maps A Second Time

Ohio’s Supreme Court has, for the second time this year, rejected Republican-drawn redistricting maps, telling the GOP officials on a mapmaking committee for a second time to come up with state legislative districts that don’t disproportionately favor their own party.

“The revised plan does not attempt to closely correspond to that constitutionally defined ratio. Our instruction to the commission is – simply – to comply with the Constitution,” the opinion said.

Should have specified which constitution, the Ohio state constitution, or the Ohio Republican Party’s Constitution.

Damn. They keep that up, the Fed Supremes are gonna have to invite someone to sue in Federal Court so they can pluck it up, overturn their previous ruling that it’s none of their business, and issue a 5-4 ruling granting the republicans their favored map.

The Fab Five on the Fed Supremes should really implement a rule that makes the entire process easier for them. Perhaps just a standing “Republicans Win” order to keep things running smoothly and prevent unfair, bitchy references to a shadow docket.

Could save a lot of money. No real reason to expend all those resources having lawyers prepare arguments and legal paperwork and go through the whole theatrical production of holding hearings when the 5-4 outcome is already locked in.

Roberts’ votes are ass covering, “Please don’t expand the court” BS.

If RBG were still with us we’d have seen 5-4 rulings still, just with Roberts in the majority.

If Robert’s really cares for his legacy as Chief Justice he’d retire.

We’d still be at a 4-5 disadvantage but the Chief Justice can change the Rules to make SC Justices have to abide by the Judicial ethics code. Surely Thomas then becomes a liability to the right…

Has anyone proposed merging the VRA and Electoral Count Act into one bill? There’s really no reason for them not to be, and that would take away the repub talking point that they’re using to distract from the VRA. I doubt repubs would go along with it, but it would let the dems put the onus back on them.

Surprised the Ohio GOP hasn’t already appealed to the SCOTUS directly. Sure, this is about the gerrymandering of state legislative districts violating the Ohio constitution. But I’m sure with a late night kegger with Kavanaugh, they can find some perfunctory reason why it ‘violates’ the US Constitution and, therefore, the original map must be accepted.

I’m thinking it’s past time for that Chief Justice to be shown the door. Obviously she is NO political hack, unlike all those who run around making such proclamations regarding themselves.

I imagine the SCOTUS would be loath to snatch a state case, particularly one dealing with the interpretation of that state’s constitution, without it going through fed lower court wickets first. Additionally, they’d probably lose in federal court, too.
