NYT: Prosecutors In Roger Stone’s Case Found Out About DOJ Reversal Through Fox News

The four (now former) prosecutors in Roger Stone’s criminal case reportedly weren’t told directly that the Justice Department would be watering down their recommended prison sentence of seven to nine years on Tuesday.

While I doubt she watches Fox, she probably knows and understands what went down. I originally called for her to call these four back in and have them testify under oath as to what happened, but she really doesn’t have to now - the truth is out.

ETA: and this almost 100% guarantees a pardon for Stone, no matter what she does.

Judge ABJ will call them in for a hearing under oath is my guess. And Kravis, being a civilian now, is free to talk to Rachel. Hopefully tonight. I may be expecting a little too much on that last part.

If Dump’s is permitted to interfere, and get away with it, what stops him from instigating and get away with it. He will sic his corrupt Justice Dept. on his perceived enemies.

She’s a federal judge with god-like powers within the scope of her courtroom, but I have a hard time coming up with any legitimate reason for her to put people on the witness stand over this. DOJ etiquette is not within her general purview.

Why? She’s not the judge of DOJ norms, and the meddling with/resignation of the prosecutors has no bearing on the issue of how she should exercise her discretion in sentencing the defendant.

I don’t know if this is significant, but an article on justsecurity.org about Barr says that on Jan. 17, Democracy 21 filed a complaint with the Justice Dept. Office of Professional Responsibility and the Departmental Ethics Office. Recent moves by Barr just adds more fuel to the fire, but I’m not hopeful that he’s ever going to get disciplined. The arguments against him are outlined in that article.

She will follow the standard sentencing guidelines, Stone will Appeal, pointing out the “revised” DOJ recommendations, the sentence will be overturned at the Circuit Level 2-1, and be referred up to the SCOTUS, who won’t take it up until next session.
If Trump wins in November, he Pardons EVERYBODY. If he loses, SCOTUS will uphold the Judges sentence, in late 2021.

Well yeah, of course she’s going to do something within the sentencing guidelines, and probably giving Stone credit for something or other that the original sentencing memo did not. But the appeal will never be decided because it will be moot after the pardon (unless Trump finally strokes out before November 4, which is not a trivial possibility).
