The notoriously right-wing Fifth Circuit Court of Appeals upheld much of Judge Matthew Kacsmaryk’s ruling on mifepristone from late last week in an early Thursday decision that may prompt the Justice Department to seek relief from the Supreme Court.

Using the “logic” behind the supposed standing in this case, can’t another group of doctors sue because they will have to treat women burdened by side effects due to the lack of safe and effective treatments related to pregnancy termination?

In Western civilization attitdues vary and have been changing in most cases. As of mid-1982, 10% of the world’s population lived in countries where abortion was prohibited under all circumstances and 18% in countries where it was permitted only to save the mother’s life.

I hope that Judge Rice comes back tomorrow saying, “With all due deference to the Fifth Circuit Court of Appalls, fuck that. This Court understands that sane, soundly-reasoned behavior combined with bat-shit crazy behavior from Texas and the Fifth Circuit places the government in an untenable position. But again, with all due deference to the Fifth Circuit Court of Appalls panel, fuck that (and the horse it rode in on, too).”

The real bonus is this puts the lie to the excuse that Dobbs just gives states the right to decide for themselves how to deal with abortion. This 5th circuit decision clearly indicates a desire for a nationwide ban.

The court’s treatment of the Comstock Act on mailing is scary. Could the Comstock Act, together with a 1909 statute extending the prohibition to express services (UPS, Fedex) mean that interstate shipments of this pill AND CONTRACEPTIVES can be prohibited? Not just shipments to consumers, but shipments to pharmacies from manufacturers?
