Since oral arguments have already been heard, the likelihood of this request being addressed prior to a decision being announced is pretty slim -especially since any such ruling at this point would signal what the decision will say about the tax returns (which are a separate issue).
That being said, Neal need to file some kind of intervening brief here. His tax returns case is being held up, in part, until both the Deutsche Bank and Mazars’ cases are resolved. (Its a Trump judge (McFadden) – I think he’s looking for ways to delay stuff.) Because the issues are so different, there is really no precedental value in either case --not to mention the fact that the Deutsche Bank case is in the 2nd circuit, not the DC circuit as is Mazars and Tax Returns.
But (presumably) because in all these cases, Team Trump is accusing the House of over-reach and a lack of legitimate legislative purpose, McFadden says he want ‘guidance’ from these appeals courts…
So Neal should maybe ask this panel, and the one in DC, very politely to hurry up…
