Moments after it became clear that House Republicans had coalesced around House Majority Leader Steve Scalise (R-LA) as their nominee for speaker, New York Republicans put out a statement vowing to go after one of their own — at least, they will once the House gets back to functioning as a governing body.

I thought that IF a person was under indictment for a felony crime that person lost their vote in the House of Representatives. One of the reasons Trump can’t be Speaker, he would have no vote. Or something like that (I am probably explaining it very badly.).

So were the previous charges misdemeanors and these are felonies? HAS Santos lost his vote already anyways?

He lost a lot of good men over Macho Grande.

Sadly, the answer is no, indictment (felony or not) does not automatically lead to much in terms of loss of abilities or privileges in the House:

There are no federal statutes or Rules of the House of Representatives that directly affect the status of a Member of Congress who has been indicted for a crime that constitutes a felony. No rights or privileges are forfeited under the Constitution, statutory law, or the Rules of the House merely upon an indictment for an offense, prior to an establishment of guilt under the judicial system. Under House Rules, therefore, an indicted Member may continue to participate in congressional proceedings and considerations. Under the Constitution, a person under indictment is not disqualified from being a Member of or a candidate for re-election to Congress. Internal party rules in the House, however, require an indicted chairman or ranking Member of a House committee, or a member of the House party leadership, to temporarily step aside from his or her leadership or chairmanship position. Additionally, a change in rules by the House requires the House Committee on Ethics to either initiate an inquiry by an investigative subcommittee of that Committee within 30 days of the time any Member of the House has been indicted or otherwise charged with criminal conduct in any state or federal court, or to report to the House the Committee’s reasons for not moving forward.

Worst is that you have to temporarily stand aside for any leadership position and get a free investigation in the ethics committee. Any other penalty would require a vote of the House majority and Republicans are not going to punish their own.

Also, if you think those ‘internal party rules’ would prevent Republicans from voting for a Speaker Trump, not going to happen.

The NY Republicans wish to rid the People’s House of the fraudster, George Santos. But as for the Fraudster In Chief, the biggest liar of them all? - Crickets. Nobody ever accused the GOP of consistency, and, after all (per Digby), shamelessness is their superpower.
