Mulvaney Backs Off Attempt To Glom On To Kupperman Lawsuit

After speaking with a judge Monday afternoon, lawyers for acting White House chief of staff Mick Mulvaney backed off their attempt to join a lawsuit filed by former deputy NSA Charles Kupperman.

Most interesting in all of this is the conflict involving the Executive Branch’s claim to secrecy vis-a-vis proprietary communications among staff and the President, versus the Constitutional rights conveyed to Congress for oversight of said Executive. So often when it’s all discussed people cite various rulings that went against Nixon in his battles with Congressional oversight and investigations, but many of those involved him eventually conceding the game before the Judicial got involved. It’s an entire field of law seemingly still fraught with unknowns and competing claims. I’d say it’ll be nice to have some of it resolved, but the House hints they’ll just abandon or skip many of the battles in the interest of expediency, or for lack of time on the calendar to litigate.

Seems a damned important set of issues to still be so undecided since 1789.

I suspect they realize Bolton is looking to testify but with the cover of a court ruling. Maybe it’s best not to piss him off.

The Judge made the right call. Kupperman is being called as a witness. Recent revelations show Mulvaney to be a perp more than a witness so the criteria the Judge would be evaluating for each is different. I think Schiff wouldn’t mind if Kupperman is a no show but I’m damn sure he wants Mulvaney in the chair.

Not the same cases.

He was never popular amongst his colleagues in the House. He’s a bratty know it all with one hell of a temper. He’s got an ego on par with Trump’s and doesn’t mind lying if it suits him. I think his biggest flaw is there’s nothing original about the man.

Trump is stuck in the predicament of “Keep your friends close, keep your enemies closer”. Abandon Mulvaney and risk he turns on you; stick with him and risk SCOTUS forcing him to turn on you anyway. And Mulvaney is but one of several people presenting Trump that quandary.

Willingness to lie seems to be a requirement for a position in the Trump WH. He has probably gotten away with it his entire life and he has never had to face someone like Schiff or the designated lawyers who will be asking the questions.

The way things are going, I don’t think they really need anyone else to speak up. The facts are not in doubt at this point, and if someone is going to present some narrative which actually defended Trump, they’d be breaking down the doors trying to get in, not avoid testifying.

True. But in the last week we’ve seen testimony that Mulvany was not just a casual observer but a messenger. That he was the guy that said investigate or no cash. Not sure if that’s true ( if it is Schiff will HAVE to look at that ) or if it’s a diversion and part of the Sgt. Schultz defense.

Yes they are important, but the legal system moves slowly. Do we want to wait or move on?
By allowing the cases to move through the system at their glacier legal pace we allow Trump to continue unabated. We continue to live in a constitutional crisis. We continue to allow him to endanger our ideals, our norms, and to destroy-everything.
