It’s been a tumultuous 24 hours for Rep. Mo Brooks (R-AL).
On Sunday, Brooks reported that he’d finally been served with a lawsuit filed by Rep. Eric Swalwell (D-CA) in federal court back in March. The suit also names former President Donald Trump, Donald Trump Jr. and Rudy Guliani for allegedly inciting the January 6 insurrection and breaking Washington D.C. laws in the process.

Don the Con filed to dismiss the case “because he has absolute immunity.” No such doctrine exists. Even the current far right Supreme Court has said so. He’s in for a world of hurt and we’re all here to watch.
Any congresscritter SO STUPID that they can’t remember their gmail login password* needs to lose their security clearance. Even more important now, considering the fears of malware being downloaded on supposedly secure devices.
*handy tip: get a password notebook. They’re only a few bucks at Staples or Office Depot. That way you don’t expose your account passwords to all of the Twitterverse.
I’m on record as opining that Swalwell’s lawsuit is unlikely to be successful on the merits, largely because he does not have any significant monetary injury. That said, the nuisance value is quite high, and the discovery value is even higher. Sic 'em, Rep. Swalwell.
This asshole goes out of his way to avoid accepting the subpoena, when even Trump waived service, taunts Swalwell for not finding him (hiding behind House rules), then throws an epic fit when finally served, exposing his password in the process.

Well, Congressman, as long as you’re throwing around statutes, don’t forget to refresh your memory on:
Alabama Code Title 13A. Criminal Code § 13A-10-9
(a) A person commits the crime of false reporting to law enforcement authorities if he knowingly makes a false report or causes the transmission of a false report to law enforcement authorities of a crime or relating to a crime.
(b) False reporting to law enforcement authorities is a Class A misdemeanor.
Yep. It’s highly likely that Swalwell has facts and the law sufficient to get him to trial, and I don’t think he’s at risk of having to pay the other side’s attorney’s fees if he loses. Discovery is gonna be pretty epic.
