Just providing more political cover for the incoming political activism of the court.

The brief is abject nonsense and exists solely to exist and be something Rao and Henderson can point to, citing its mere existence as further support for their shredding of the Constitution and our criminal justice system.

In Monday’s filing, the Republican senators backed the executive branch’s “exclusive discretion to begin and to end a prosecution.

IOW, the law depends on the political and personal interpretations of whoever is POTUS at the moment.

I guess I’m really stupid–or stupider than they are–because I simply cannot conceive how going to bat for a DoJ that is, in effect, going to bat for a twice-self-confessed traitor to his country is going to do them a lick of good, especially within the context of a failed presidency that they have aided and abetted via sins–yes–of commission and omission.

The prosecution already ended. Flynn pleaded guilty. He was awaiting sentencing. Barr decided to end a prosecution that was already completed. The judge is not interfering in a prosecution, nor denying the DOJ the right to terminate one. He’s questioning their right to terminate a prosecution that’s already over with.

What is going on at DOJ is NOT, as NYT claimed, about the Unitary Executive. Call it corruption–which is what the Stone and Flynn interventions demonstrably are, call it authoritarianism (which is a belief the Constitution doesn’t matter, not a theory of the Constitution).

According to Emptywheel, the brief by the ten GOP house members was excruciatingly bad. And then:

Thank you, traitorous Senators, for letting us know exactly who stands to fair poorly should Flynn spill.

This isn’t even remotely a question of law and certainly not something the legislature should even have a say in whatsoever.

If Turtleface wants to try to get a bill declaring Flynn exonerated through the House, give it a go, until then, STFU and sit down.

The senators who joined McConnell in filing the brief were Sens. Tom Cotton (R-AR), Mike Braun (R-IN), Kevin Cramer (R-ND), Ted Cruz (R-TX), Chuck Grassley (R-IA), and Rick Scott (R-FL).

This is called the great distraction. See, they don’t want to get into trumps mix but because they have been reported to be silence on the protest and COVID virus that is sweeping across the country they have to seem like they are doing something before tRump turns his attention to them for not watching his back. Cotton & Cruz waded into the protest only to be slammed on twitter over the weekend so they had to somehow keep face.
Michael Flynn is a TRAITOR.
