Three years ago, the idea that the Department of Homeland Security would not have a Senate confirmed secretary for six months would have been laughable.

But now, the fact that someone is “Acting DHS” for only six months is remarkable…

At some point in the not too distant future, President Warren needs to sign legislation that allows only a certain percentage of the President’s cabinet (and any other position requiring the Senate’s vote) be “Acting” this or that title for said department. Additionally, departments with “Acting” heads must have a nomination from POTUS within six months of “Acting” person being named.

This crap Donald is pulling on the government employees in these affected departments–as well as the American people–is not right on many levels and shouldn’t be allowed to continue. There are many places we need to shore up our government rules and regulations. We obviously can no longer rely on future POTUSes adhering to norms, rules, regulations. We obviously need to craft laws to ensure that person operates within expected boundaries as much as possible.

McAleenan is/was a career government employee in a variety of positions.

Working for Trump was a thankless job that he disliked—and was above his skill level.

He did a lousy job because he had a lousy boss.

interesting in theory, but insofar as cabinet secretaries serve at the pleasure of the President, ita a highly impractical idea.

And also that the Acting has to follow an established line of succession, so the president can’t skip over the competent people to appoint an acting shill and keep him/her forever without confirmation.

Cabinet secretaries serve at the pleasure of the president, but senate confirmation is required. Trump uses the acting designation to avoid that little constitutional requirement.

Yeah, I’m sure it would be litigated immediately and for a long time. My suggestion is we do it after we’ve increased the federal judiciary by 50% (yes, that includes adding a few seats to SCOTUS) and filled nearly every available seat before we try my idea. On second thought, that might mean waiting til close to the end of Warren’s first four years in the Oval Office.

The Federal Vacancies Reform Act also limits how long an acting officer can hold a vacant Senate-confirmed position. An acting officer may serve “no longer than 210 days beginning on the date the vacancy occurs,” or “once a first or second nomination for the office is submitted to the Senate, from the date of such nomination for the period that the nomination is pending in the Senate.”

When McAleenan was appointed, it was said that his predecessor was not tough enough, and now he’s ousted for the same reason. How far will the ttump admin go?

One of the articles I read about the incident at Georgetown Law mentioned someone from a Catholic Charities organization that works with immigrants. They complained about the protesters, they needed this forum to work with DHS, well I say “Hey at least you didn’t waste your time trying to figure out how to work with the guy that had one foot out the door.”
And in another article it describes McAleenan as a “process guy”, someone who like the logistics of making policy’s work. I guess he found out that philosophy of a policy has to place in the process.
