You’re a lawyer and I agree with you about what should happen (I said my points were BS, but that they’d try), but a lot of other lawyers are out there saying that the ruling yesterday gives Trump a federal angle if the supreme court agrees to take it. That’s in Josh’s posts from this morning.

I hope you’re right, but this court is corrupt enough to jump at the chance to push this into next year.

Appeal goes through the state appellate courts. Only then can he try to take it to SCOTUS, and only to SCOTUS – not any of the other federal courts.

Fine. I don’t know the details and why I didn’t specify where he’d take it at the Federal level. But you’re picking nits here. He’s going to the SCOTUS by the fastest route possible if he can’t get the state to toss the conviction.

The fastest route possible to SCOTUS goes though two or three years of state appeals. He can’t snap his fingers to move the case to SCOTUS.

Since Trump said the legal work was personal, why did he expense it to the business? He stated that over and over, not paying attention to the fact that he claimed a personal expense as a business expense.

If handling a personal or business expense is an official act of POTUS, then so is breathing. Trump was supposed to put his business in a blind trust, so he had no reason to do anything related to the Trump Organization. Paying Cohen for personal legal services isn’t an official act- it’s paying a bill. As I recall,

SCOTUS has gone insane to protect Trump from his own bad acts. There’s nothing conservative in what they did. What the six did is judicial activism. The Right used to be scared of that, but now they’re embracing it because that activism protected their guy.

BTW, Presidential Immunity sounds a lot like the new Qualified Immunity. SCOTUS again proves it will make shit up to protect what it wants.

Sentencing has been moved to 18 September 2024. I expect that Merchan will schedule one or more hearings between now and then on whether the whole conviction must be thrown out and Trump re-tried. The Supremes have fucked everything up. As Howard Dean observed tonite, the United States has joined Poland and Hungary in having a corrupt and invalid Judiciary. A Democracy cannot survive without an honest and functional Judiciary and we lost ours yesterday. We cannot get it back while Alito and Thomas remain in Government - full stop.

Andrew Weissman is good with the move to September

Judge Merchan moving the sentencing to mid September is smart. It gives Trump and DA and the court time to brief the issues, but Merchan will ultimately reject the weak Trump claims, and importantly the new mid-September sentencing date will make it VERY hard for Trump to then be able to appeal to SCOTUS before the election as he will have to appeal within NY state courts first.

As I understand it, he needed to be president to be immune according to SCOTUS. Some happened before he was president, like working with pecker to catch and kill the McDougal story for $150,000.

Some of it seems to have happened after he was president like some of the payments to Cohen and falsifying business documents.

Hope Hicks’ testimony would have been barred based upon the SCOTUS immunity ruling. Hard to see how his conviction survives this new standard.

The Rethugs think all will be well because they are RIGHT, and we are WRONG. And they are so sure of that, that they cannot envision any outcome other than we all become compliant little sheep like they are and somehow abandon any pretense at logic or facts.
Small men with a lot of power have destroyed more civilizations than any plague. And I put hardcore religion right at the top of that list.

Trump is a lifelong abuser of our legal system. We are playing chess while he is playing roller derby. I live in hopes that Merchan or any one of the judges just throw out his appeals on the basis of being frivolous lawsuits.
