The New York conviction will be overturned. Yes, it is in state court. Yes, it was for actions that happened before Trump was president, mostly. It’s the mostly part that’s the problem. The Supreme Court will use that to invalidate the entire conviction. We know that, we know this is their goal.
If Trump was sentenced as scheduled, and immediately sent to prison, by the end of the day the Supreme Court would have figured out a way to get him out. They have that power. They have whatever power they want, as they have made clear.
There is no solution to our problem of Trump in the courts because the courts have become completely corrupt at the highest levels. There may not even be a solution to the problem of Trump at the ballot box, because the court has taken that much power.

Elie Mystal, recently, shouted that they would never give him more power than themselves. I wasn’t that surprised by this decision, as a layman. The legal scholars seem caught off guard. Anyone else experience this observation?
Just because they were signed in the Oval Office does NOT mean they were official acts. The checks were from Trump’s business related to activities that occurred prior to his election. He was conducting personal business from the Oval when he signed checks and met with Cohen there. That falls squarely outside of official duties, regardless of the location.

Trumps defense was these were payments for Cohen for personal legal work. And that somehow might be covered under offical acts of the president? Its insanity.

I agree with you, but there’s another wrinkle, unfortunately.
Even if signing the checks were not official acts, the Supreme Court decision says that prosecutors cannot use evidence related to official Presidential acts as part of the proof of the criminality of unofficial acts.
So, for example, if part of the evidence that Trump’s unofficial act was a crime is a statement that he made at a White House cabinet meeting - that statement, which was ostensibly part of an “official act”, could not be used to prove the alleged criminal unofficial act.
So the Trump crew will argue that the trial evidence included at least one official act, and there is no way to tell if that was the key piece of evidence that led to a conviction, so the verdict has to be vacated and a new trial held. (Which Trump will be too busy to do before the election.)
Two ways that DJT would continue to be a felon through Election Day -
- Merchan hears argument in September, postpones sentencing pending his decision, and doesn’t decide by Election Day
- Merchan decides that, even if evidence related to alleged official acts was removed from the trial, the remaining trial record was more than ample to support the jury’s verdict, and then sentences Trump.
In both cases, Trump could pursue appeals (much harder to do successfully with Option 1 than Option 2), including potentially an emegency appeal to the US Sup Court, if they choose to entertain it.

They might have had a point if they had objected to the evidence during trial. They did not. Evidentiary objections that are not made before the evidence is admitted are waived. This is not a hard call.

The checks that Trump signed to reimburse Cohen for his payments to a porn actress were recorded as business expenses on the Trump Organizations books. To characterize these as “official acts” does not pass the laugh test.
But that is not to say that the corrupted SCOTUS would not rule that they were official. If it came to a vote, it would probably be beyond the pale for Justice Barrett.

September? Short in legal but not political time. And whatever Merchan decides, there will be at least two appeals in NY. Even if those appeals are expedited, there would be an appeal to the federal courts (perhaps directly to SCOTUS).

If this case has to be retried because of some new definition of evidence, now considered inadmissible by this Supreme Court, I’ll be pissed. They rejiggered nonsensical rules as guidance to benefit tRump, which SCOTUS made up out of whole cloth. I hope Merchan can see through the smokescreen SCOTUS intentionally created to help tRump get off the hook. Looks like tRump gained a lot of new ways to get his appeals taken up in the court with SCOTUS’s ruling yesterday as well.
September? That Stinks. I was so hoping for some kind of news in the form of sentencing in July. My patience is wearing thin for justice to be administered to that asshole for all his criming. We are all still being kept waiting…
