There was nothing illegal or undemocratic about that text. Every Representative and Senator takes an took to uphold the Constitution. This good member of Congress was simply advocating for the states of GA NC PENN and other R controlled state houses to exercise their constitutional power to “appoint, in such manner as the Legislature thereof may direct, a number of electors.” The fact that they would be directing the manner of appointment after-the-fact could be somewhat problematic, but McConnell has put them on solid ground when it goes to the SCOTUS.

Only real question now is whether Biden & Garland have the stomach & nerve to take this all the way, given the political risks and costs this would likely entail and the massive blowback from those feral Trumpie beasts and their AR-15s, antlers and zip ties. I think the risks and costs of not pursuing this all the way vastly outweigh the risks and costs of doing it. We’re going to have our little Civil War Part Deux eventually. Might as well just get it over with than wish that it just fizzles away. We didn’t go all the way with the CSA and look what happened. We did go all the way with Germany and Japan and look what happened.
