The courts have repeatedly shown Kobach to be as dumb as a fucking bag of hammers, and one judge sent him back to school. he’s lost in court every time. Morons never learn.

Justice Sotomayor is the one responsible for this particular appellate court.
She is highly unlikely to present this for cert.

Cannot the other Justices allow the appeal? I didn’t realize that it was up to a single Justice.
It takes four justices to agree that the case should be heard in order to grant cert.
This keeps the majority from controlling the docket.
The “cert pool” made up of clerks for all the justices (except Alito and Gorsuch) divvies up the cases presented and then the clerks’ synopses of the cases are read by the justices and a decision is made about whether or not to grant cert.
The Circuit Justice (in this case Sotomayor) is responsible for deciding whether to grant stays or lower court decisions and several other technical aspects of the circuit judges rulings.
