This decision is just restating that they were never part of it and remain apart.

The Great White Father didn’t see that coming.

Trust me, I get that. I would just like to see the State of Oklahoma officially downsized.

Reduced Congressional representation? Fewer Electoral votes? etc.

Yes! I hope this emboldens tribes in other states to assert their ownership of their land s according to treaty. Well past time this issue is addressed,

The reservation remains located within the state of Oklahoma. What today’s decision seems to do is affirm that members of the tribe who are alleged to have committed crimes on land formerly ceded to the tribe by treaty are not subject to prosecution by the state’s courts. It does not appear to prevent state prosecution of non-members, nor does it appear to resolve anything regarding private ownership of tribal lands.

You mean the United States is going to have to live up to treaty commitments? What a blow to Donald Trump. He doesn’t believe in living up to any commitment in any circumstance.

Seriously just how is Tulsa going to function in the Res. Is the city going to have to become a legal entity of the tribe. Are non-members of the Creek Nation going to have the right to vote in local governance elections?

They already did, 40 years ago. The decision was to compensate the tribe for the taking, not the return of the land.

Oh well, it was worth a shot…

Thanks.

Hardly. It just means the individual states can’t override treaty commitments on their own. The feds can still pretty much abrogate them at will (although Gorsuch is a surprisingly strong voice on making everyone abide by those treaties).

I wonder if this would have implications for pipelines, covid-19, and all the other things that are ongoing on tribal lands

Yeah that would be cool but at least I believe tribal members working on that Rez escape state income tax (definitely no fed income tax)
