Justice Kagan Warns SCOTUS Legitimacy Could Be In Jeopardy

As public confidence in the Supreme Court plummets, Supreme Court Justice Elena Kagan on Thursday warned of the dangers of the high court losing its legitimacy if its decisions are or appear to be motivated by personal politics.

Right. I have absolutely no faith that the current majority on the court will do anything solely according to the law. They are as partisan as partisan gets, and they simply don’t care beyond that. They are not to be trusted at all.

Came here to say that too. “Could” doesn’t begin to describe the situation. The court’s legitimacy is already gone for half of the people in this country who are paying attention to what it’s done lately.

The other half isn’t thinking in terms of legitimacy either. They just like seeing their tribe in power.

It definitely left port for anyone who was around in 2000 when they effectively decided for Bush in Bush v. Gore.

I still ruminate from time to time what could have been different if they had not overruled the Florida Supreme Court and allowed the recount to proceed: Gore as POTUS, no Iraq war, leadership in ameliorating global climate change, and on and on.

And if trump were put on trial for his role in J6 why would anyone need more damning evidence than what the J6 committee has made public?

That ship sailed quite awhile ago. Most notably when McConnell illegitimately stole a seat, and it could letigtmately (irony noted) be argued going back to Bush v. Gore.

Kagen said what needed to be said. She, appropriately, pulled her punches. If the highest court again needs to add seats, it’s never too early to lay out the case and to provide a foundation. Perhaps she foresees possible ex-POTUS related cases on horizon and wants to put out a message. I reckon TPM readers weren’t her target demographic. It could help with a few independents in the November 2022 general election. Since she cannot be fired, more of this, please.
