I suspect that the reason he wasn’t released from El Salvador earlier was that it took time for them to get this cock-and-bull story fabricated. I mean, Abrego Garcia would have had to have been way stupid to engage in such behavior as a person without citizenship. I always heard that most immigrants here without full legal status went out of their way to avoid notice. It almost seems that Stephen Miller, Pam Bondi et al. actually believe that all immigrants are criminal activists whose only purpose in life is to flood the US with more immigrants. Their paranoia is showing.

Yup, it sounds very fishy especially since the US attorney in Nashville resigned due to this case. From an ABC piece.

The decision to pursue the indictment against Abrego Garcia led to the abrupt departure of Ben Schrader, a high-ranking federal prosecutor in Tennessee, sources briefed on Schrader’s decision told ABC News. Schrader’s resignation was prompted by concerns that the case was being pursued for political reasons, the sources said. Schrader, who spent 15 years in the U.S. Attorney’s Office in Nashville and was most recently the chief of the criminal division, declined to comment when contacted by ABC News.

People in positions of power used to worry about the judgement of history. However, to borrow a phrase from Joe Scarborough, everyone in the Trump administration appears to be a “day trader”. They do whatever they need to do to realize the latest inane request from their boss, or show their willingness to conduct the cruelest possible policies and effect the greatest possible damage on the perceived enemies of the administration. Do they think MAGA will be in power forever, meaning that there will never be a reckoning, or are they just so happy to have temporal power that just don’t care about their legacies or how they are viewed by history? In particular, what does Marco Rubio think his image will be in 10 years?

If Abrego Garcia isn’t convicted, Trump/Miller/Bondi/etc. will use that as proof that the US justice system doesn’t work and they were right to kidnap people and ship them overseas. If the economy hasn’t gone to shit by then it might convince some voters, but if there’s a recession all of this extremely expensive cruelty (combined with the corruption) will be a hard sell outside the Kool-Aid tent crowd.

Every round of tax cuts and defunding of the IRS creates more right-wing asshole billionaires who can set up scam foundations that will provide Republicans with sinecures. Get elected, say and do horrendous things, then cash out with a do-nothing job and a trophy third wife. There’s nothing deeper than that, sadly.

I second that Yup. ABC and Guardian don’t have much more detail, but implies that the federal Chief of Criminal Division mid-TN resigned in protest of a politically motivated prosecution of Garcia … but his resignation statement does not say such.

Ben Schrader, announced his resignation as the chief of the criminal division at the US attorney’s office for the Middle District of Tennessee in a LinkedIn post on 21 May, the same day the indictment of Ábrego García was signed by the acting US attorney for that district.

Sources told ABC News that Schrader stepped down because of concerns that the case was being pursued for political reasons.

Exactly. TSFF caved. They’re now doing theater for the MAGAts. He won’t be convicted on any of these charges. I’m guessing almost all will be dropped before trial.

But they don’t want to look like they’ve caved. These charges are all for show.

If they even get to trial, the corrupt witnesses will be a liability. And Abrego gets to sue for malicious prosecution.

That means in a year or two, there will be a hearing on further delaying the trial because it’s so close to an election, and anyway the government is guilty of cruel and unusual punishment.

Like with Grampa Trump, I hope this defendant is afforded all the rights to which he’s entitled. For as long as it takes.

Recall that the Bukele government and MS-13 have some kind of mutual assistance pact. It may well have taken time for Bukele to facilitate the fabrication of some tissue of a case against Garcia and put it before a grand jury.

  1. The habeas case probably isn’t moot because he’s still in custody.

  2. The contempt and sanctions for violation definitely aren’t moot because the court retains continuing jurisdiction to enforce violations of its prior orders.

  3. There should be a bail hearing early next week to determine pretrial release. Expect DHS to ignore bail and detain him for deportation separately pending trial. More proof the habeas relief needs ruling.

  4. Prosecutors have no viable way of proving the people in the vehicle with KAG were undocumented aliens. They almost certainly can’t even establish their identities.
