A federal judge ruled Monday that President Trump does not have the power to block former White House Counsel Don McGahn from showing up for compelled testimony in front of Congress.
Nice. But it will appealed and Judge Rao will come with some bullshit reason to give Trump cover. And then it goes to the Supreme Court where Roberts & Kavanaugh conveniently will sit on it until after the next election.
There will be an appeal, but this is now part of the impeachment process so any appeals will be handled quickly by the courts…unless they hit a judge who wants to delay for Team Trump of course.
This is really a big deal decision…it’s the only way the decision could go if we’re going to remain a nation of laws, but it really was critical for the courts to rule this way. No absolute blockage means that people have to show up when subpoenaed, and they have to testify or give an explicit reason why executive privilege applies to the question. Anyone that tries to skip out now faces contempt of Congress, at a minimum, and this is going to force a lot of things out into the open that we may not have received otherwise. It will also hopefully encourage some people like Bolton to cooperate instead of fighting against history…we’ll see if anyone voluntarilyj comes forward.
The big question is how the administration will deal with this…they now have to decide if they are going ignore the courts or if they will follow the rulings and law. It’s no question what Trump will demand they do, but how many underlings decide to refuse a legal court order is really an open question, especially when the lawyers face sanction or disbarment for their actions.
It’s a good day for this decision to come out, now we wait to see if it changes the course of events.
The House lawsuit against McGahn was the first filed by Democrats to force a witness to testify since they retook control last year. The Justice Department, which is representing McGahn, is expected to appeal Jackson’s ruling.
Is there a mechanism for determining that a judge’s written opinions are out sync or out of whack with standard judicial theory and practice? Can they put Rao in the corner until her time is up?
The Democrats are saying it constantly, that’s the entire reason we have an impeachment in progress. Blaming the Democrats for the Republican’s criminal behavior makes as much sense as saying the Democrats shouldn’t wear a short skirt when they walk into an alley.
