Per Lawrence Tribe, there is little to no chance the District Court Judge’s decision will be overturned on appeal and so it is doubtful the DC Circuit will issue an injunction. By Friday the Archives data issue wiil be moot.
The next question is when will AG Garland indict Bannon. He has a Judicial Branch decision to stand on, so it could happen this week. I have my fingers crossed.
If Jan 6 was an attempt to prevent the lawful transfer of executive power, this whole plea by that former guy is to prevent the lawful transfer of executive privilege.
… And I really wish he would. It would be about time, and it would send a signal that the Congress and new President aren’t messing around. By letting that former (LOSER!) guy exhaust all legal remedies imaginable, appeal by tedious appeal, they risk getting new and BAD precedents set by hack Federalist judges appointed by you-know-who. And it delays the Committee’s investigation.
Trump already signaled his intention to appeal Chutkan’s ruling in a filing this week, asking to be allowed to do so before she came to a decision on the matter.

Joe is playing it straight, as he should unless and until the courts say (within the next couple months) that he can’t. At which point, there is no impediment to releasing any document held by the White House.

More seriously, federal judges aren’t fooling around. Whether it’s castigating prosecutors for not seeking higher levels of punishment for 1/6 insurrectionists or statements like this, they recognize the gravity of what unfolded on that day of infamy.
Laurence Tribe, bless his heart, always predicts court procedings as they should work, not as they do. If a three judge panel evaluates the appeal request for injuction, and that three judge panel includes Rao and another conservative judge who is vulnerable to being buffaloed by Rao, then the stay will be issued. I say this because that is exactly what happened with one of the congressional subpoenae of TFG’s tax returns 2(?) years ago.
I swear that during the closing statement of the 2nd impeachment trial, just before Jerry Nadler pre-empted him, Adam Schiff was going to say “America has no king. America needs no king.”
Why the incendiary headline? Do we really have to use phrases like “judge shoots down” to describe what has transpired? Please do better. I expect to see phrases like that used by other news outlets, not TPM.
Perhaps Trump has outlived his usefulness to these Federalist Soc. jurists. There does seem to be a slow-motion jettisoning of TFG going on. One can only hope.
