The federal judge in the census citizenship case imposed limited sanctions on the Trump administration Thursday for the Justice Department’s failure to produce hundreds of documents it was obligated to turn over before the trial.
So implied by this judge’s ruling: sure, there might have been a criminal conspiracy within the DoJ to suborn perjury and falsify evidence, but if it’s really a problem it’s the DoJ’s job to investigate it.
Judicial branch seems to be neutered into the equivalent of some lint in the corner unless you’re un-moneyed and un- white. Methinks it’s less than a minute til midnight for American democracy.
And to expand a little further on that thought, this is precisely the sort of action that makes a special prosecutor law (one of the Watergate-inspired reforms) a necessity.
the record did not show that the witness “intentionally” misled the court. Nor was there “clear and convincing evidence of bad faith,” Furman said.
Let me get this straight: you can withhold relevant documents and get clearly caught in a pretextual reason, but neither are enough evidence of bad faith?
