Judge Rips Trump Administration For Games Its Played In Rushed Census Case | Talking Points Memo

"Defendants would have missed the completion rate requirement despite Associate Director Fontenot’s declarations under penalty of perjury that they would not,” Koh said.

IANAL, but isn’t this a crime?

Nah. I don’t think you could really prosecute someone for perjury for a statement predicting future conditions like that (altho again, I don’t really do crim law). That he was under oath certainly highlights how flippant and unserious they were, but his statement, at the time it was made, was more inherently subjective than an objectively knowable fact.

Three cheers for Judge Lucy Koh! (She’s an Obama appointee, by the way.)

It’s about time the Trump Crime Syndicate was held to account, and its own words and records used to convict it. Trump – and Republicans in general, too – have been skating by for decades now; “IOKIYAAR” seems to almost be part of the US Constitution. They’re all used to the opposition just giving up, writing atrocities off as a lost cause and too costly to pursue. For once, this isn’t happening.

No wonder Trump is raging through the West Wing, screaming at everybody he sees, and tweeting his little thumbs off. (If only…)

Not even close. He was just expressing his well informed professional opinion and cannot be held responsible for the failure of the census takers to do their jobs. Some people say the census workers were hired by Soros* to undermine the Trump administration.

* @castor_troy and @rucleare have all the details

@sniffit beat me to it, but his comment is flawed by its lack of appropriate sarcasm

I love Judge Koh’s standing up to these criminals. YA bench slap for this “administration.”

Yes, but it would be very difficult to secure a conviction under the “beyond a reasonable doubt” standard unless there was contemporaneous, documentary proof that he did not believe the statement to be true at the time he signed his declaration.

Depends on the actual words issued by Fontenot, but the judge seems to have at the very least caught him in some contradictions, which cannot be good for his health.

How many people have already made it to Trump’s Pardon List™ for lying to the FBI, Congress, or the courts?

Until a judge starts slapping assholes for contempt and throwing them in the hoosegow, it’s all hot air. Unless, of course, the judge invalidates the census.

Can anyone explain why these judges don’t sanction individuals who lie in their pleadings, ignore court orders, and do the things they do. There is no punishment for bad behavior, why do people think that it will stop. Don’t rip bad behavior punish bad behavior including the lawyers who support this subversion. It is a time delay process so that there is no time for relief. It’s like LeJoy ignoring Judge Emet Sullivan’s orders and nothing happens. I bet if I did these things my a** would be in jail. Maybe is these people spent time in jail they might think before the lie and cheat.

Let us be very, very clear: however you came upon this juicy bit of gossip is your own damn business to mind, and I’d be careful about hauling my good name and that of my honorable partner @castor_troy into your scheming machinations. But we are not who you have to fear. I’ll just pass along to @rascal_crone the fact that a certain someone is bandying about innuendo-like assertions inre information that may or may not be held by SOROS GROUP International for entirely laudatory reasons, and see what happens from here. (If you have a summer cottage, I’d plan to winter there before nightfall.)

Not so. A Michigan judge is trying to get Sidney Powell disbarred and another judge has threatened sanctions against Lin Wood.

Having a federal judge explicitly call this out doesn’t seem like a good thing for the called-out party.
