Judge Just Blew a Gaping Hole in the Comey Prosecution

Originally published at: Judge Just Blew a Gaping Hole in the Comey Prosecution - TPM – Talking Points Memo

The extent of the prosecutorial and investigative misconduct in the James Comey case is even greater than previously known, a federal magistrate judge revealed in an extraordinary new ruling today. The judge was tasked with deciding whether Comey had met the very high bar for a defendant to be given full access to the transcripts…

This is exactly how one would expect a convicted felon to behave if elected president.

Moreover, this is exactly how one would expect a felon with 34 felony convictions who is still facing 10 additional felony charges in Georgia, who has five deferments from military service, blonde hair plugs, and an orange spray tan to exactly behave if placed in the office of the president.

And finally, fuck everyone who voted or allowed this to happen.

Call it what it is: the “Trust Me Bro” indictment.

Comey can now credibly argue that he was never actually indicted by the Grand Jury.

In another instance, Halligan “clearly suggested to the grand jury that they did not have to rely only on the record before them to determine probable cause but could be assured the government had more evidence – perhaps better evidence – that would be presented at trial.”

Um . . .wut?

This article explains everything so clearly! Thank you @david_kurtz for making it make sense to a non-lawyer.

Who knew that you had to not be a complete fucking careless ignorant corrupt dipshit to be a DOJ prosecutor. Looks like a deep-state conspiracy to me.

Do you think (and if so, to what extent) any of the law firms that Trump extorted into working pro bono for him are contributing work on these sham cases?

The judge sounds like a law professor tearing apart the inept performance of a struggling law student in moot court. She should be bounced out of law school for these blunders–or maybe told to go back to trying to study insurance law.

The photo that the NYT includes on the app version of the story is not doing her any favors in the “I am a reliable professional” competition

Wow! It’s as if Trump has an off the shelf, bottom of the line Public Defender to represent him! – er, represent “the federal government.”

This is what happens when the government eschews experienced career prosecutors in favor of inexperienced MAGA partisans. Criminal procedure is demanding and complex, considering the protections contained in the Constitution and the decades of jurisprudence interpreting those protections. An inexperienced attorney cannot just jump in and get it right, and those with a predilection for playing it fast and loose and on the edge (or across the edge) of dishonesty (particularly common in civil litigation) will have a particular challenge.

Hey, MAGA…

Aren’t all these blonde babes supposed to be in the kitchen baking cookies?

Are y’all goin’ feminazi on us now?

Does anyone else get the feeling that the judge is carefully packing a powder kegs, which he will then gently stack all together, before blowing the entire magazine up Halligan/Bondi/Hair Furor’s faces?

If so, it’s going to be spectacular.

Note: Too bad didn’t blow it up today – it’s Pam Bondi’s birthday!

It’s a really good thing that most of these these fascists are stupid and incompetent.

I think I spotted a problem with your analysis. Trump is not POTUS, he’s the COTUS=Chairman Of The United States. And he also thinks he’s the sole owner of the Federal Gov’t. The Senate and the House are upper management in COTUS. And he got here with a hostile takeover.

Josh M:

One question I have in this unfolding of events is the role of the Epstein story. Whatever inherent importance it has, it has had the effect of not only making Trump look guilty but — I would argue more importantly — impotent and absurd.

Post-Epstein it seems like Trump’s lost his Midas Touch.

“Come on, debate me bro” would be the best response to a judge asking to see their work ever!
