Without going to specifics, I have some experience in the realm of private companies as public figures. If I had to make a preliminary guess, there is a substantial likelihood that Dominion will be ruled as a limited purpose public figure because it voluntarily inserted itself into the most fundamental public controversy of all – our public elections.

Which will limit remedy I guess but they’re never going to recover what they’ve lost and will lose. I see this as more of a deterrent than remedy. If Dominion is successful it will rock that part of the attorney world. Draw attention by licensing and regulating entities and possibly give others send thoughts before advancing the agenda of a demagogue with their legal credentials.

Maybe, but even public-figure defamation plaintiffs can get pretty clever with their expert witness damages testimony. And I expect Dominion is going to have really clear proof of lost actual and future sales, since just about no local election authority in the country is going to buy anything with their name on it out of concern that the wingnuts will freak out.
The real trick to winning big on a defamation claim is to show the jury why they should hate the defendants for being such total scumbags that they would say the defamatory stuff. I am confident that Susman Godfrey will do that in spades with these garbage people and companies as the defendants. I would consider cleaning Rudy’s clock as a test trial, then using the outcome to extract 9 figures in settlement from Fox News.

They sold voting machines, and pretty good ones at that AFAIK - handling paper ballots and creating a paper trail that can be compared after the fact to the actual ballots for audit purposes. How does that constitute voluntary insertion into a fundamental public controversy? The Republican Party, tRump Administration, the Kraken’s, Lindell and others manufactured the controversy by constant lying with absolutely no concern for truth and no evidence to back any of their claims.

Powell had argued that “no reasonable person would conclude that the statements were truly statements of fact,” and that she was instead speaking as an attorney and advocate for Trump’s campaign when she made her outlandish Dominion claims.
This idea that any lawyer can say whatever he or she wants in the context of and election (or theft of an election) seems to be going around. As Rudy apparently said, this is just “throwing a fake.”

But it also means it’s not acting as a deterrent for anyone else not named in the suit, to prevent them from also poisoning the airwaves same as this bunch. IMO, prevention is better than hoping for a cure years down the road.

On Nov. 17, the Trump lawyer appeared on Newsmax and claimed to have evidence of Dominion’s founder admitting that “he can change a million votes, no problem at all.”
Powell said she would “tweet out the video later” — but she never did.
“These statements are either true or not; either Powell has a video depicting the founder of Dominion saying he can ‘change a million votes,’ or she does not,” Nichols wrote.
Unless I’m missing something, the Judge basically summarized Dominion’s case for them.
Any guesses on who is the first to try to cut a deal with Dominion to try to lessen their own liability/damages?

That would be nice, but you know they’ll be twisted into showing up to make sure no one votes. Whatever can sell Serpent DNA as a reality has powers beyond imaging. Except then we remember plain old vanilla religion still successfully sells the devil.
