He is dumb as a brick, he believes he is smart, and like my mother used to say the worst kind of fools are those with initiative, but he always comes up with Wiley E Coyote schemes, that end up blowing in his face. There’s no stay, so unless Ron Vara gets one from a higher court as part of the appeal I’d assume federal agents are already sending the appropriate communications to the ProtonMail people. I suspect the next thing is an order to Navarro to deliver the key (unless ProtonMail has it) and a request to the court to hold him in custody until he coughs it up.

My recollection is that other people have spent time in jail while deciding to give up their keys. (Or, if the FBI has the capability, they will just unlock the account and be done with it – this isn’t so much about getting access as about getting access in a legally bulletproof way that will enable future use of the documents.)

Smart or intelligent people can be stubbornly dumb in certain areas. In this particular case I think Peter knows that what’s in those documents can cook his goose.

If we had a government that didn’t rely on such but had codified guardrails, Trump would have never happened. I’m actually surprised Trump didn’t happen a century ago. Unfortunately, we’re now too far down the road to replace those traditions with laws because one party has internalized the belief that traditions are for suckers and that the real money and power lie on the other side. Without all three branches in full true Dem control (cough Manchin, cough Sinema) we will never be able to put the laws in place that will keep us safe from the Banana Republicans.
