Great decision, and makes it clear we still have judges that value and follow the law. This will likely be appealed directly to the SC, as another “emergency” (based around protecting the nation from “evil immigrants”), and the SC should bounce this. It was obvious gaming of the rules to put Cuccinelli in the office, if the SC signs off on it then there are no longer rules about appointments, and the president can just ignore the Senate and appoint whoever he wants.

Great, but so what? Everything the Cooch decreed or did while in power still stands - or will, once an appeal is filed - and he’ll remain in power up through when the Supreme Court gets around to hearing the case (no hurry…). Then they’ll either rule for Trump or he’ll dictate that the Supreme Court’s rulings mean nothing because he, and only he, is The Law.

The Republican Congress will back him up, of course.

Not that I fault the Democrats and other law-respecting folks for trying. This will lay down a clear paper trail for future historians to marvel at.

The Drumpf people have succeeded in doing crap like this from day 1. Put someone in, let them do their thing as destructively as possible, drag out the court challenges while the very real effects are hitting people, then shrug their shoulders and say, “oh, well.”

I used to think that Trump had an endless supply of incompetent people available to appoint to exec branch positions. In light of recent developments (e.g., trying to recycle appointees that have been previously ineligible or rejected) I’m now beginning to reevaluate that assumption.

But that probably isn’t true.

I think Roberts lost a lot of his credibility by “presiding” over the impeachment trial with even less leadership than you’d get from a potted plant. If his credibility is in an urn on his nightstand, Roberts’s spine is in Mitch McConnell’s sock drawer.

It takes a combination of incompetence and venality that’s pretty extreme to begin with, and increasingly it also takes the ability to ignore the near-deafening warning bells that any half-sentient being would be hearing while considering taking a job offer in this disastrous administration. Diminishes the pool of potential appointees considerably.
