And statements like this: “Miller also argued that the committee’s subpoena could include private conversations ‘with doctors and other healthcare professionals’…” are in there to deliberately mislead the public. The courts, the committee, and Miller et al are fully aware that all the phone provider has is routing data. They also know that that data is property of the provider, they have no more ownership interest in it than you or I. The provider notified them as a courtesy, getting their own ducks in a row and shielding themselves from challenges as they prepare to comply with the subpoena. The subpoena, just like a warrant, is limited and specifies which phone numbers are under scrutiny and a limited time frame describing the call records to be examined. No one else’s records will even be looked at.
They’ll stall, but in the end, like all the others, the committee will see the data, and use it to reconstruct the who, when and where of conversations that took place in that time frame, but not the what. The what, you can be pretty well assured, is already known to the committee from other sources and witnesses, or they wouldn’t be interested in the data.
