Justice Ketanji Brown Jackson turned the favored tactic of her right-wing peers on its head Tuesday, advancing an originalist argument to support protections for racial minorities.
Let’s hope her argument doesn’t fall on the deaf ears of this right-wing, partisan court.
As Earl Landgrebe said on being the only member of the 535-member House of Representatives to vote against accepting the Judiciary Committee’s report on impeaching Richard Nixon, “Don’t confuse me with the facts. My mind is made up.”
Jackson’s brilliant of course. The problem is the five hard right “justices” on the Alioto court are not interested in legal arguments, precedent, or even the rule of law. They are interested only in achieving their agenda and will fabricate whatever ridiculous argument is needed to fill the requisite number of pages in their decision.
The Sleazy Six don’t realize that there is a breaking point where people will lose all confidence in the courts and they will turn on the system with full blown jury nullification.
They have to know that a lot more people are watching what they do now than did just 3 months ago. All the money that put them where they are will be blaming them soon enough.
They are smart enough to know that is where they are heading, I am not sure a complete demolition of the judiciary as it is currently constituted isn’t the ultimate aim of the Federalist Society. In short your concern might be a feature and not a bug.
It was their vanity that got them into this, and it will be their vanity that will stay them. All these humps want to preen. Can’t do that when you are universally loathed, and you certainly can’t when your tepid arguments have been run up and down all day by better minds.
Some form of vanity in these twerps has kept the ship right all these years. You can trust the pompous to be proud.
I have a real problem with this headline in that it is a total lie.
“Jackson Turns Originalism Against Conservatives To Argue For Minority Voting Protections”
There are actually two lies. The first is referring to the Republican majority on the court as “originalists”. Protecting minorities from the “tyranny” of the majority is the very purpose of the courts and reason for lifetime appointments according to James Madison who wrote the US Constitution.
But the bigger lie here that TPM keeps repeating is that the majority on the Supreme Court are at all “conservative”. Protecting minority rights in regard to the constitution is as “conservative” as it gets and again is the very reason for the third branch of government.
I wish just once TPM would have the stones to call the current Supreme Court what it is, the enforcement arm of the Republican Party.
