No. trump can’t be charged with conspiracy based on anything government officials do for or with him in exercising his official authority, but not all such acts are undertaken in trump’s official capacity. If ginning up the fake electors was, as the indictment alleges, not an official act by trump, then all the evidence of his government minions carrying it out is admissible against him at trial.

We all know this, but the GOP majority ruled that a president may direct DOJ to help him overthrow the constitutional order, with impunity, because a president giving directions to DOJ is acting within his official duties. It’s just crazy. The person who takes an oath to “preserve, protect, and defend the constitution” may with impunity use his office to render the constitution null and void. Doesn’t pass the smell test. The SCOTUS majority has no clothes. I know, ew.

They claim they’re protecting the president’s powers to take bold and decisive actions. I have to admit that overthrowing the government and installing yourself as a dictator probably counts as a bold and decisive action.
