Jack Smith Drops Holiday Filing In Jan. 6 Case Asking That Trump Be Barred From ‘Injecting Politics’ Into Trial

Special prosecutor Jack Smith has evidently been working through the holidays, dropping a surprise December 27 filing in the January 6 insurrection case against Donald Trump.

This is a companion discussion topic for the original entry at https://talkingpointsmemo.com/?p=1476819

Jack Smith has a mind like a bear trap, does not shrink from his duties, is knowledgeable of the law, and is a skilled prosecutor. For that I am extremely thankful.

I second that.

The mere fact that Jack Smith has not gone postal on Trump and his team of “attorneys?” says much about the man’s maturity and patience. I cannot wait to hear one of these cases wherein Trump gets his fat mouth taped shut with duct tape to make him shut up.

How can the lawyers for the criminal former president keep politics out of the trial, unless they are able to talk about politics? They just want to prove his innocence.

Yeah, I know it doesn’t make any sense. But here we are.

Keep the heat on, Jack, stay or no stay. Heat on tRump causes forced errors.

As written:

“How dramatically the Supreme Court’s move will delay the case is yet to be seen;“

Edited to include underlying rationale.

How dramatically the Supreme Court’s move to help their fellow Republican will delay the case is yet to be seen;

But, hey, any little bit helps Trump delay and therefore to deny or thwart justice.

NAL, but trump seems to think the DC Jan 6 stay means everything everyone all at once stops any work. I would think Smith could file anything he wants so that it would be sitting there on day 1 after the stay is removed… and Smith explains this in the title footnote. Trump is an idiot who can’t read.

1 The Court has determined that the deadlines in the Pretrial Order are “held in abeyance” while the defendant’s appeal of the denial of certain of his motions to dismiss are pending. ECF No. 186 at 2. Nonetheless, to provide the Court and defendant notice and to promote the prompt resumption of the pretrial schedule if and when the mandate returns, the Government will continue to meet its own deadlines as previously determined by the Court.

Well, he did prosecute war criminals such as Kosovo war crimes probes in The Hague.

I don’t think that tfg ultimately wins from trying to mess with a jury pool.

“None of [Trump’s] issues goes to the defendant’s guilt or innocence; all of them should be excluded.”

Because Donald Trump is guilty. We all saw it and heard it.

He sat on his ass when the Capitol was violated.

Republicans saying that government is broken and run by incompetent bureaucrats are proven wrong every day this team goes to work. I love it.

“Drops”

Does that mean he did or he didn’t?

It’s a nonsense modernism that has no place in a article on a serious topic.

“Crooked Joe Biden’s errand boy Deranged Jack Smith is so obsessed with attacking President Trump and interfering with the 2024 Presidential Election, and is so sad that the Supreme Court just unanimously rejected his desperate attempt to rush this Witch Hunt, that he is ignoring the law and clear instructions from District Court Judge Chutkan, who unequivocally stated that this ‘case’ is stayed and there should be no litigation. Period,” his statement said.

Is he referring to himself in the third person? “Smeagle hates the nasty hobbitses!”

I don’t know about others but, I find it insulting that he continues to refer to himself as President. Wasn’t there a judge who admonished his lawyers for doing the same?

How well does ‘move to strike the statement from the record’ actually work with a jury? Once the words are out there, they will not be recalled. The judge will most assuredly instruct the jury, but are those instructions enough to prevent consideration of these statements?

Think of how unprecedented this all is. Former president who won’t shut up and injects himself five times a day into the national dialogue. Who has some kind of Svengali control over the entire R Congress… As they rat f*** the daily govt. business.

A former prez. who is spending all his time and political capital to fight and discredit our national institutions, 3 years after he was told to go away.

Well, I guess he thought we didn’t mean it……

Yeah, just like Jimmy Carter when he went and…started building houses for the disadvantaged.
