It’s a feature of the Trump era that his norm-breaking behavior is met by unprecedented responses.
While meritorious, disqualification should be used carefully. How about disqualification requests occurring after Trump’s first criminal conviction? While he is clearly a career criminal, con man, and led a coup, a criminal conviction is an important milestone that, perhaps, even 2 of the Supreme Court’s right wingers would agree meets the constitutional standard for disqualification.
I ask fellow commenters here what they think.
I’m not onboard with disqualification in general, but it’s especially concerning to me how quickly some at least are eager to dispense w/innocent until proven guilty
So Trump should not be disqualified until found guilty in at least one of his criminal cases?
If they use this it will be litigated until it is fast-tracked to the SCOTUS whose fascist majority will put on their magic glasses and read the complete opposite of what is clearly written in the Constitution. It’s not like they don’t have a history.
ETA: Then they will say its decision is not to be used a precedent.
The good old liberal media at work again. As a liberal I’m indifferent to Trump’s nomination chances. Either way it’s going to suck for the Republicans.
For the conservatives it’s much different, the sane ones want nothing to do with Trump. To cast this as liberal wishcasting is disingenuous.
He should be D.Q.ed, but odds are against it. That is no reason to stop the process. Evidence presented through the attempts to block Donald and his elected unindicted (so far) collaborators will allow some of his current supporters to change their minds.
Remember too, other stuff happens.
"In the Georgia and Arizona cases, judges blocked the challengers from obtaining and displaying the evidence on which the disqualification was predicated. That made it very difficult to prove that the lawmakers had engaged in an insurrection. "
This reminds me of the fact that a thorough investigation of Kavanaugh was “blocked” by Barr’s DOJ. Many complaints by people who knew him were not allowed to be investigated. Disqualification is a serious matter and charges deserve an unrestricted investigation. Certainly there are people who should be disqualified and those who are being railroaded. We should be able to learn the difference.
In the case of Trump v Everyone on Earth, a felony conviction for mishandling (sharing? selling?) classified documents alone should be grounds for disqualification. In what universe should someone proven to threaten our national security be allowed the opportunity to do it again? This makes no sense.
I don’t understand how he can be disqualified from the ballot.
In Pennsylvania we never voted for Donald Trump, we voted for wise and dignified electors who choose the president.
I think that we, the electorate, should accept our responsibility to vote for someone else and not hope that some prosecutor, judge, or, who ever else, is going to save us from this short fingered vulgarian.
Seems like this is an issue of Republicans, not courts. It’s their party primary and parties are private affiliations, not part of the government. Giving major party primaries public funding and the endorsement of state governments is how we got into this two party mess in the first place.
The general election, which is run by and for the public, is another matter.
Christamitey!
Innocent until proven guilty only applies to officers of the court and juries. The rest of us are free to presume whatever we want.
Unfortunately, I don’t know that it will suck for Republicans. If/when he gets the nomination, there will be lots of grousing but eventually every (okay, vast majority) of R voters will vote for him - I’m convinced. Remember, they fall in line, unlike Democrats.
Yes! Because if Trump is disqualified without a court finding him guilty then Trump gets handed the biggest “victim card” in politics, ever.
Common guys Donnie is the biggest manipulator that we all have ever encountered in our politics. Donnie ain’t just a politician, he’s G-D cult leader!
For me disqualification is tied to insurrection as the 14th amenfment says.
Trump took the oath.
At his ellipse speech he told followers to go to the Capitol and fight like hell the idea being to stop certification of the election. But also the assault was planned in advance. Donnie’s intent is clear. So that ought to be enough to convict him of seditious conspiracy and to disqualify him from any and all offices for life.
My attitude is also not to overemphasize any state efforts to disqualify Trump from the 2024 general election ballot if he is nominated. The efforts can continue but they are only setting the case for lawsuits by Trump and the Republican Party. The federal courts are not going to allow a major party candidate to be disqualified in selected states on the basis of the 14th amendment without judicial branch approval. The Supreme Court will ultimately decide the question on an all 50 states decision.
Trump has no need for the Supreme Court if he gets elected president again.
I think the SC justices are probably aware of that.
Regimentation, outside of the military, is incompatible with a secular democracy.
