A surrogate’s court in New York on Thursday dismissed a request by President Trump’s brother Robert Trump that sought to block the publication of a book by their niece Mary.
I’m almost certain that there’s a memo composed by the DoJ OLC that’s filed somewhere in Barr’s office that states categorically that the nieces of presidents cannot write books about their President uncles owing to the doctrine of the Un-impugnitary Executive.
SCOTUS here we come (whether it’s appropriate or not)!
Only Trump lawyers would think you can confer subject matter jurisdiction on a court by contract. (Trust me, if you were a lawyer, you would be all like “oooh! Burn!” and high-fiving me.)
Mary should frame all of the winning Court opinions she’s likely to collect.
Maybe even send Trump framed copies (I hear he likes framed things with his name and image on them, and now that his “foundation” no longer exists to buy them …).
Dear Bunker By…your niece may have signed an NDA. That doesn’t mean she “isn’t allowed to write a book”. All it means is that if even if she’s found in violation of the NDA, all she has to pay the penalty stated in the NDA. That’s all. I’m sure she has considered that and thought that publication is worth the price. Now, shut the fuck up.
That was some seriously crappy lawyering. They sought an injunction on an NDA in a probate court for an estate closed nearly 20 years go. Subject matter jurisdiction is first year law school stuff. Robert Trump should ask for a credit for the hours wasted by his counsel.
Good luck with prior restraint in correct court! It doesn’t take a first amendment lawyer to know this isn’t happening.
Yeah, that pesky first amendment thing. The courts have already weighed-in on prior restraint (e.g., Pentagon Papers) and said NO, If the Pentagon Papers can be published, a Trump tell all should be obvious. Mary may have to pay whatever financial penalty the NDA requires AFTER she publishes, but she can weigh the costs.
Indeed. The likely remedy is suing her into oblivion AFTER it is published.
I’d be interested whether the NDA contains language preemptively agreeing to issuance of a prior restraint type of order though. If the court is reading that out of the NDA, that’s quite something.
I would use the Bolton book as shredded liner for my cat’s litter box. He might just like a “change of pace” from his usual compressed and absorbent pine chunks.
