After the Supreme Court knocked down Alabama’s gerrymandered map in June, court watchers, redistricting experts and those invested in which party controls the House of Representatives did quick napkin math to figure out where that decision would redound.

And now we have Steve Scalise, self-described as “David Duke Without the Baggage” having a good shot at Speaker of the US House of Representatives. Anybody else see GOP defining themselves right before our eyes? They think this is good strategy? The Federalist Society must be so proud!
Is there ANY way that it can be realized that representatives elected under “unconstitutional” districting would not be constitutional representatives? Can Congress simply refuse to certify them?
The damage that the Republican Party and the Dark Money groups have done to this country is limitless. Please stop voting for Republicans, if you prize our democratic systems.
This is the nuclear option that I would like to see tried at least once. Hold elections under a map that a court has declared invalid (and higher courts have sustained), and too damn bad. If only to see the Gang bending itself into higher-order knots explaining why constitutional requirements for elections, as implemented by congress, are not constitutional.
Seriously, though, there’s nothing obvious that limits this kind of anti-democratic behavior by states to gerrymandering. If a state passes a poll tax or a new literacy requirement and a court strikes it down, all the state apparently has to do is ignore the court for long enough. Unless you’re going to have the federal government sending federal marshals in to supervise election officials.
