Serious question. Have not seen any reporting of ‘Kavanaugh stops’ by law enforcement other than ICE and CBP? Is there evidence that incidents of racial profiling have spread to street-level law enforcement? This article is the first indication I have seen of concern in the legal and civil rights community that the approval of Kavanaugh stops can be interpreted as broader than immigration enforcement.

Donald Trump has demonstrated that he is a racist year after year after year. The facts of his statements and actions are in evidence.
I don’t think any other law enforcement office would be able to defend using race as a reason to violate the Fourth amendment, because ICE and CBP are the only federal law enforcement agencies that have a brief anywhere close to race (immigration status).
I also, obviously, do not think Kavanagh stops are constitutional. I don’t think it’s constitutional for the federal government to detain anybody for any length of time without a warrant (public safety being the only exception).
Well, if you’re in the business of deporting non-citizens because they’re black or brown or otherwise not white, why not go ahead and deport actual citizens while you’re at it? Saves time and gets you closer to the real goal.
First off, I have an issue with the title for this article. The fact is Trump’s immigration crusade is endangering ALL Americans. But like with many other events happening, it does endanger Blacks more than others.
But before getting to that I want to answer your question.
Over 20 years ago the Republican majority on the Supreme Court ruled that citizens have very little expectation of privacy and therefore can be pulled over and stopped for any, in fact no reason. Furthermore, once stopped, there is nothing any longer that prevents being held and searched.
I know about this because many states Supreme Courts to include Illinois came up with ways to reign in the racial profiling the Supreme Court was now allowing. In Illinois the state Supreme Court using 5 cases, 3 of which my wife worked on as an attorney, became known as “The Disneyland Doctrine”. It basically says to police “that while you can now pull over Blacks and other minorities for any Mickey Mouse reason you want, you can’t get Goofy.”
That is for over 20 years as a result of Bush appointing Alito to replace O’Conner, one of the first results was to allow racial profiling so long as the police did not say they were racially profiling. That is police today need very little reason to stop and search as constitutional protections were restricted to the home.
What Kavanagh did was take away the BS and allow for saying what was already happening, racial profiling. That is what Kavanagh allows is for police to get goofy.
But to my title of this article. I call anyone who has lived in America since childhood and now in their 20s or older “my fellow American”. That is while Blacks are more likely to suffer from the lawlessness of Trump enabled by corrupt and compromised Supreme Court, we are all endangered.
Oh geez. Have you never heard of the dastardly offense of DWB (Driving While Black)? Cops have been profiling black folks since they bought their first cars. Same with brown folks.
