I’ll be interested to see the opposition brief, because Hice’s legal argument is actually pretty persuasive.

Hice thinks the Speech or Debate clause applies to him.

His argument is that the electoral vote certification proceeding is legislative, and that gathering information about the election and planning the objections are therefore legislative too. I can’t conclude he’s wrong about that either.

I don’t see how this applies. He is not being arrested (yet) and his actions did not occur in the House.
