A lawyer for Ryan Kelley, a leading Republican contender for Michigan governor after a signature forgery scandal cleared the field, asked if his client could keep his gun after he was arrested on charges related to the Jan. 6 insurrection last week.
I think being prone to fantasizing about shooting folks not the best trait for a Governor but who knows? Running to FOX is not exactly an act of courage or grit. Why is this asshole running?
And I just read the weak-broth gun bill is faltering in Congress because the GOP wants to loosen the red-flag provisions. I don’t know what the rationale is, but here it’s the conflation of having guns and the right to protect yourself. And we’re seeing the gun lobby more and more arguing against literally any restrictions on gun ownership at all. I’ve heard from most gun owners for decades that certainly there are some people who shouldn’t have guns. But the lobby, now, they’re drifting away from that. So GIVE MONEY. VOLUNTEER. AND MOST OF ALL VOTE. Nothing else matters.
Red-Flag laws have always been a very sticky thing. Lots of due-process questions and the how of the implementation is important.
In a country where the mantra is innocent until proven guilty, going around that and stripping a right without proper due process is not something to be taken lightly. Looks like the “how” of passing funding to States, whether they can use funding for other programs and whatnot is on the line, relatively drab and usual stuff so far. Plus concerns, since these are State laws, in how they get executed and what level of levers the Feds can put on the cash.
See, when I ask what the rationale is, really what I’m looking for is whether it’s so flimsy a regular dope like me can see through it, or if there’s actually been an effort to make it sound good. We regularly deprive people of their right to move about freely if they demonstrate that they’re a potential danger to themselves or others. If you get a protection from abuse order levied against you I’m pretty sure you’ve demonstrated that danger. But it’s guns, and guns are special, so we’re super-extra concerned.
Newsflash: A pistol is not a defensive weapon. It is designed and used to propel bullets rapidly towards a target. Until they invent one that makes the user bulletproof, they are offensive weapons, which may, MAY “equalize the fight.” I’m so sick and tired of this self-defense/stand your ground bullshit.
Ex’s and neighbors with disagreements over the length of grass within the HOA have never been known to conjure up ways to make someone’s life miserable just because they can.
Given that these go right to the courts, just defending oneself against a malicious allegation immediately runs into the thousands of dollars with lawyers and court appearances.
But sure, let’s just toss due process out the window, the Left really isn’t into any of the Bill of Rights, not just 2A.

I have strong feelings about responsible gun owners when a dear friend of mine’s youngest daughter was acting erratically. My friend has two daughters, they both were taught to shoot, and competed at the Jr level for the Jr Olympics. My friend’s husband was safety conscious and had a gun safe where all firearms were stored. When my friend mentioned her youngest’s mental problems I asked her if she or her husband had changed the combination on the gun safe? Her youngest was finally diagnosed with bi-polar disorder which is great. But it can take time to get the right meds, or combination of meds correct.
I think I may have offended my friend, because we haven’t really talked much since then.
Which is why I believe that a judge has to presented with evidence before acting on removing someone’s guns. Will it be used maliciously, probably, but I rather err on the side of caution.
People have due process rights. Property does not. It’s not a due process violation for the state to seize property in accordance with whatever laws are on the books and to thereafter afford due process to the owner to get it back.
And yes, I’m aware of the abuse of civil forfeiture laws.
And that is the crux of this argument. It is the gun nut, irresponsible, macho boys who are pretty sure that they will get their guns confiscated bit by bit, as they use them irresponsibly, and that just pisses them off.
Responsible gun owners have made it clear that they want control over the guns that these morons possess just as much as the rest of us.
